I think they usually charge negligent homicide. This has an element to prove of "evidence of a depraved mind."

4. So what could prove that? Statements to the other officer perhaps. Need to look at the Minnesota pattern jury instruction. If they don't have a hate crime statute this might be the charge they apply if they have proof he's KKK or some other domestic terrorist group.
