Case against #UGC guidelines to resume hearing tomorrow in the Supreme Court. Usually courts don`t interfere in the policy decision of the govt. UGC is a statutory body. In the affidavit filed by UGC, it has raised the same concern. /1

UGC in the affidavit, has stated that court usually don`t interfere in academic policy of the govt. UGC, as of now is the apex body of higher education in the country. The work of UGC is majorly regulatory in nature especially with regard to grants. /2 #31studentinscagainstugc

The authority, jurisdiction, power & policy framework of #UGC comes under strict scrutiny now, as the States claim that they have more authority over UGC. It is in this deadlock situation, the petition of Mr. @AUThackeray gains greater importance. /3 #CancelExamsInCovid

His petition claims that states must be allowed to decide based on the prevailing local situation of the pandemic. Whether States can invoke epidemic law to curb the functioning of institutions & cancel exams during a pandemic is subject to judicial perusal. /4

UGC vs State govt is a constitutional crisis now. This is pivotal, as Union has decided to replace #UGC, #AICTE with a single regulator authority. The power of states with regard to higher education vested in the State govt is likely to be transferred to this new commission. /5

UGC has tactically deviated the court by saying that it is a policy decision. If this is accepted by the supreme court, court can`t cancel final year exam. It may direct UGC to reconsider the decision. But it can`t order the UGC & nullify the guidelines of UGC. /6 #CancelExams

Also Mr.Aditya Thackrey has gained the good will of millions of students of Maharashtra & other parts of the country. If his petition is allowed, it would boost his image across the country. His political opponents (we all know who are those) may not want that to happen. /7

So in my opinion court may not provide relief to the final year students, even though the UGC guidelines is weird & illogical. Court may adjourn the hearing. They may not stay the guidelines of UGC. I wish & expect the court to act swiftly & cancel exams in favor of students! /8

Though it is my opinion, we will have to wait & see the observation of the Hon`ble Supreme Court tomorrow.
