Adv Gopal Sankaranarayanan: This year has been the worst ever in conducting CLAT. This exam was conducted online
Justice Ashok Bhushan: This was a difficult year?
Sankaranaryanan: Other online exams were also held this year. CLAT consortium says 21,000 objections were recieved
Sankaranaryanan: In lot of questions, wrong model answers were given. Out of 40,000 objections, 20,000 were on question and answers. I am on the other 20,000. The cut off in this exam is not even 0 but -4. This is not only in this exam but in the history of any exam
Sankaranarayanan shares the CLAT 2020 UG Invite list on the screen.
Sankaranarayanan: This list has students who have got marks as -4. These students have been called for counselling
Justice Bhushan: We will ask Mr PS Narasimha to respond
Sankaranarayanan: In one of these questions on what is obscenity the answers are wrong and not in consonance with the Supreme court judgments. Since it is law we can assist your lordship. only 3 out of all 50,000 students have secured 50 percent marks
Senior Adv PS Narasimha: retired chief justice looks into these objections. the list read out is only for the SC ST candidates and they have been only called for the interview and the calling makes no difference.
Justice Bhushan: but why have they been called?
Narasimha: in pandemic there cannot be unending counselling
Justice MR Shah: what is the minimum marks? if someone has got minus marks still they will be admitted?
Narasimha: what needs to seen is it is alleged that number of questions is lengthy. but the length has reduced from last test. so far as software glitches is concerned, this is an extraordinary exam. even a movement of mouse by the student is recorded.
Narasimha: Unlike IIT JEE , no payment is required to be made for raising objections. we have kept it open ended. 146 and 150th question raised a lot of objections and thus those questions were dropped as per expert committee recommendation.
Narasimha: Out of 2600 seats, 1800 seats are already filled. rest, counselling is on. the exam has been done it excellently well and all Vice Chancellors have participated in this. one question was defamation is a crime or not. objection was answer is not as per what google says
Narasimha: One of the candidates Apoorv Sinha had filed a forged document. no affidavit has been filed on his behalf.
Sankaranarayanan: I hope NTA comes into the picture as these people are completely incompetent to conduct the exam. Technical software issue is not addressed
Sankaranarayanan: There are 20,000 objections on technical glitches. It is a habit where judges names are dropped and I don't know if a particular judge has gone through that particular question.
Justice Bhushan: you can submit a representation to the grievance redressal committee. Thereafter a decision can be taken.
Sankaranarayanan: let it not be a fait accompli situation here where counselling is wrapped up meanwhile
Justice Bhushan: we will not pass any interim order and we cannot stop the counseling process.
SC: petitioners themselves have filed a letter dated September 27 by which the grievance redressal committee was constituted headed by retired Chief Justice of India. We give liberty to petitioners to make a representation before the committee within two days.
SC: A decision will be taken at the earliest.
Matter over
