Bench of Chief Justice and Justice GS Kulkarni hearing the matter pointed out that they can pass guidelines for safer travel.
AG Kumbhakoni for State argued that they were trying to open the sectors in a phase-wise manner so as to ensure there is no burden on the medical care facilities.

But since now, the number of affected people is reducing, they have started opening more sectors.
AG also pointed out that citizens are not strictly complying with social distancing rules.

Court asked State to assess new demands that will come up after opening of new sectors.

Court clarified that now they are concerned for travel of all people whose work sectors have now been opened and not just lawyers.

They added Court will look into the timings of the Court to see, if they can help reduce the burden of trains during peak hours.

AG submitted State will increase the number of buses to help employees travelling to their workplaces.

AG: But opening u p railways is not so easy. You can't use logic that because markets are open, open trains. It does not work like that.

Court reminded Kumbhakoni that the job of a State is to impose strictures.

ASG Anil Singh informed that more than 2 lakhs people had travelled yesterday.

He suggested that if courts keep flexible timings, travelling crowd will get distributed.

CJ recommended the State to consider some regulations adopted by the Kolkata metro services.

CJ: There is apparently going to be a second wave of this pandemic. You will have to come up with something (referring to safe travel) before that.

Court directs the State and the railways to come up with some schemes, so as to ensure that not everyone comes to the platform at the same time.

Court asked AG to ensure there is ministerial intervention and invite suggestions from all stakeholders for a long term solution.
There was a consensus amongst Court, petitioners, state and railways, that all employment sectors must divide the time amongst themselves.

For eg: bank employees travel from 9 to 3, lawyers come from 10 to 5, other employees can travel from 12 to 6.
Advocate AM Saraogi for one of the Petitioners placed before the Courts another difficulty of the lawyers, being that they cannot afford to travel by taxis and cool cabs, as the cost for transportation was high.

Sr Adv. A. Anturkar appearing for the petitions filed for grievances of travelling for registered clerks, pointed out that even the registered clerks ought to be allowed to travel by trains for courts.

The Court at the end permitted all lawyers from the MMRDA region to use the local services for one week following the guidelines of September 15 (lawyers receive certificates from the court to travel for their matter for that 'one day')
The Court will pass an order in the afternoon and the matter will be listed in the next week for deciding on the larger issues.

AG: Supreme Court in Rojer Mathew had upheld Section 184 of Finance Act in its entirety which says that the tenure should not exceed five years.

Adv. Abhinav Chandrachud appearing for Thakkar points out that a fresh FIR is filed with BKC police by same complainant.

Chandrachud seeks directions to the police to not arrest Thakkar as he is going to co-operate with the police and for a copy of the FIR be given to Thakkar.
Court notes that Thakkar had previously not co-operated with the police based on records which show there were several notices sent.

Chandrachud points out that as soon as the Court granted him protection from arrest, he appeared before the police station.
