Good morning! ☕️ Senators' time is up for Qs with Amy Coney Barrett and the Judiciary committee will vote to send her nomination to the Senate floor on Oct. 22 at 1 pm.

Also this exchange happened last night, so... yeah.
Sen. Mike Lee is currently raising his voice about the "abominable treatment" of Brett Kavanaugh during his confirmation hearing.

Were we watching the same hearing? He shouted, wailed, lashed out at members of the committee, straight up lied about little and big things.
"Y'all have a good chance of winning the White House," Lindsey Graham tells Democrats on the Judiciary Committee.

How long til Trump trashes Graham?
Lindsey Graham keeps saying he supported Sonia Sotomayor and Elena Kagan because they were qualified, even if he would have picked someone else. Says Dems won't do the same for Barrett.

That argument falls pretty flat after the way he treated Merrick Garland.
John Cornyn is feigning confusion about why Dems are angry about Barrett being confirmed.

Here is John Cornyn in March 2016 when he blocked Obama's SCOTUS pick Merrick Garland from getting a hearing or a vote, saying it's wrong to confirm a SCOTUS pick in a prez election year.
"I recognize this goose is pretty much cooked," says Cory Booker on Barrett's confirmation.

Notes some "troubling things" he's heard in the hearing, like Barrett evading Qs on race. "Surprising" she refused to answer Qs about if she believes in a peaceful transfer of power.
The Judiciary committee just voted on a motion by Sen. Blumenthal to adjourn Barrett's confirmation hearing until after the election.

It failed, of course. Along party lines.
The committee's done with talking about itself now.

Now it will hear from panels of people supporting and opposing Barrett's confirmation.
Ted Cruz promptly heads to the cameras in the hallway outside the hearing to talk about the NY Post story on the Bidens, Twitter and communist China.
Josh Hawley just accused Facebook and Twitter of trying to rig the presidential election -- feeding right into Trump's grand plan to try to delegitimize the election as he looks on track to lose.
GOP senators love to rip the American Bar Assn as a bunch of liberals when they give a bad rating to a Trump judicial nominee.

But behold! The ABA gave Barrett a "very well-qualified" rating and its lead evaluator is one of the GOP's chosen speakers in today's hearing.
I covered the TX Lege for a few years. I've covered Congress for 13.

Watching Barrett's hearing, I'm reminded of a constant I've seen w/ GOPers in a majority: their emphasis on decorum + collegiality as they push thru policies that will hurt women, ppl of color + low-income ppl.
John Cornyn says Amy Coney Barrett "understands diversity" because she adopted two children from Haiti.

"I don't think she needs to have anybody preaching to her about the importance of diversity."

There is something rich (& infuriating) about Karen Pence trying to make mental health & suicide prevention her signature issue when she works at a school that bans LGBTQ teachers and kids.

LGB kids consider suicide at almost 3 times the rate of hetero kids, per Trevor Project. Image
Look at these stats on LGBT youth and suicide rates, via The Trevor Project. Devastating. thetrevorproject.org/resources/prev… Image
Meanwhile, the school Karen Pence continues to teach at discriminates against LGBTQ people in its job application and says LGBTQ kids aren’t welcome.

Great scoop last year by @rklein90. huffpost.com/entry/karen-pe…

Today is the last day of the 2020 Census count. The Supreme Court rejected a lower court's order to extend the count after serious delays because of COVID.

This makes it easier for Trump to not count lots of people, esp minorities + tribes. This is what he's been trying to do.
This is easily the most damaging development this week outta the Trump admin.

This final stage of the census count is the only stage being cut short. It's the most crucial part for reaching "hard-to-count populations." Which largely happen to be... communities of color.
Non-English speakers + low-income people are among the hardest people to count.

They rely on census takers coming to their homes in this final stage of the count to do “nonresponse follow-ups" b/c they didn't respond via the internet, by phone or mail.

Day 3 of Amy Coney Barrett's confirmation hearing.

Dianne Feinstein opens, again, with family talk.

"I'm delighted to see your family here again. I hope they feel that very special sense of pride in you.... I was thinking of my children and grandchild."
Progressives have been fuming at Dems like Feinstein for treating this situation as business as usual.

“It’s becoming increasingly clear that Democrats are not doing enough to show that this is an illegitimate process w/ an illegitimate nominee." huffpost.com/entry/democrat…
Barrett, again, won't say whether a president can unilaterally delay an election.

She says she won't discuss “legal hypotheticals."

Today, Senate Democrats spent hours pressing Amy Coney Barrett on health care, abortion and her potential role in a 2020 presidential election dispute.

She dodged all of their questions. m.huffpost.com/us/entry/us_5f…
Progressives have been urging Democrats to show a fiery, united opposition to this entire process, framing Trump’s Supreme Court pick as an illegitimate nominee in an illegitimate confirmation hearing.

That... didn’t happen. huffpost.com/entry/amy-cone… Image
Amy Klobuchar brought it, though.

“We need a bit of a reality check that this isn’t normal right now,” she said. "We shouldn’t be doing this. We should be passing coronavirus relief.” huffpost.com/entry/amy-cone…

Dianne Feinstein's first question to Amy Coney Barrett in her confirmation hearing: I was wondering if you could introduce us to your children and family.
Feinstein: Do you agree with Antonin Scalia's view that Roe v Wade was wrongly decided?

Barrett: I can't pre-commit or say, "yes, I'm going in with some agenda," because I'm not.
Back to praising Barrett on family stuff.

"You've got a lovely family. You understand all the implications of family life," said Feinstein. "I'm proud of you for that."

Here's today's snapshot of each state's progress in reducing COVID cases/hospitalizations/death, via covidexitstrategy.org

Green is trending better.

Yellow is caution warranted.

Red is going downhill.

Bruised red is uncontrolled spread.
Overall, it looks worse than a week ago.

Here's Oct. 5 vs Oct. 12.
The West Coast is looking worse compared to last week.

There are still just 2 states in the country trending better right now: Maine and Vermont. It was 3 a coupla weeks ago, but New Hampshire took a turn.
