1. On the @Twitter @Facebook dust up, stolen emails carry potential civil liability. The ruling in the SDNY civil case brought by the @HillaryClinton and @TheDemocrats for Trump campaign use of Wikileaks/GRU hacked emails was dismissed because the court found the emails were
2. in the wild. But this recent @NYPost drop is an initial posting of stolen emails. So IMO the Post is acting as @WikiLeaks. Could these platforms face both civil and criminal liability? If they are betting that question may be answered by a @JoeBiden appointed AG running
3. @TheJusticeDept the decision to back away from amplification makes good business sense.

18 U.S. Code Chapter 119. "WIRE AND ELECTRONIC COMMUNICATIONS INTERCEPTION" has been used against the press. If you use illegally obtained private material, you are exposing yourself to
4. both civil damages and criminal damages. Trump campaign got away with it in 2016 because WikiLeaks was initial distributor. This time it was Trump campaign acting as the GRU and the Post acting as Wikileaks and IMO even under the questionable ruling in the Clinton SDNY case,
5. this time it was smart to block it because punitive damage lawsuits and criminal charges are generally bad for a corporation's shareholders. @CNBC

1. Trump is one of the most transparent liars I've ever witnessed. So what's going on with Rick Gates? We haven't heard from him in a long time. I think I'll take a look.
2. I missed that Rick Gates was on @AriMelber @MSNBC hawking a book yesterday. I think I can guess what he's trying to do. The only thing new the USDC docket is there is a new Asst US Attorney in his case with specialty practice.

1. After graduating from law school in 1990, I worked at a Bankruptcy boutique firm. Brilliant lawyers, all much smarter than I. But all willing to fill an empty vessel. After two years I struck out on my own and, as a small business owner, tried to keep my library expenses down.
2. I took Con Law as an undergrad and since then I've tried to keep current on all US Supreme Court cases. So I called SCOTUS' Clerk's office and asked if I could download the cases. They said only Westlaw & Lexis could that. I told them that I it sounded an antitrust violation.
3. A few weeks later they knocked it off. Allowed @Cornell Law School to do it. I've gotten the cases via email every term since. I think my oldest sister gave the speech at her graduation from Cornell. I missed it, but I think somebody told me that. Probably my brother.

1.1928, the stock market was rolling along when an anti-prohibition Irish Catholic ran as a Democrat. Anti-Catholic hate raised its ugly head and Hoover won by a landslide. Then the stock market crashed in October 1929.
2. Factories closed and commodity prices plummeted wiping out the farm economy. By 1932 people were desperate and fearful and the map flipped from red to blue. FDR began is promised recovery but it was stymied by right-wing activist judges who shared Judge Barrett's views.
3. Like her they sought to roll back health and safety protections and block FDR's recovery plans. So FDR threatened to add justices. But the conservatives relented, with two crossing over. Liberty, worker protections and the safety net are a one-way street. We're not going back.

1. Will @SenateGOP religious extremism bring on a period of overt religious sectarian conflict because beliefs can be made the subject of attacks and ridicule by a Catholic #SCOTUS? If Christian right need not respect others' religious beliefs, why should others respect theirs?
2. Will Catholic belief in the Holy Trinity and virgin birth, LDS beliefs in Latter Day Saints, Evangelicals' belief that prayer is maters over good works, become the subject of overt sectarian attacks? Why shouldn't people who don't adopt the Evangelical, Mormon,
3. Catholic view of life be subject to the others' religious beliefs and overt sectarian hatred but Evangelical, Mormon, Catholics, not expect it in return? It's easy. It's in the Constitution stupid. @CatholicBishops @SenateMajLdr @SenMcSallyAZ @SenatorCollins @SenCoryGardner
