JUST IN: Defeated 2016 VP candidate Bongbong Marcos seeks inhibition of Supreme Court Associate Justice Marvic Leonen from his election protest vs VP Leni Robredo before the Presidential Electoral Tribunal. Asks for reraffle and resolution of pending incidents.
Marcos himself was present during the filing of his motion seeking to inhibit SC AJ Marvic Leonen from his election protest case. But he did not grant interviews. An online presscon is scheduled at 10am.
Why does Bongbong want Leonen out of PET election protest? He cites Leonen’s position in the Marcos burial case as evidence of bias vs Marcos family and a 2-part news article on The Manila Times.
ONGOING: Bongbong Marcos holds presscon with spokesperson Atty Vic Rodriguez about his motion for SC AJ Leonen to inhibit from his election protest. Says he was forced to file bec Leonen supposedly did not do anything in election protest after the pandemic.
Marcos faults Leonen for seeking OSG’s and Comelec’s comment on whether PET has jurisdiction to annul votes in 3 Mindanao provinces. Claims Leonen delayed resolution of and has prejudged case. Says Leonen hostile to him and Marcoses.
Marcos previously sought inhibition of SC AJ Alfredo Benjamin Caguioa from the PET when he was member in charge but PET denied it. Says he hopes Leonen does “self-examination.” Says Leonen is “biased, partisan, prejudiced.”
Marcos denies any links to move of lawyer Lorenzo Gadon and Office of the Solicitor General to oust Leonen through a quo warranto proceeding over his SALN. Says he tried to stop Gadon (inaawat) from pursuing QW case vs Leonen.
Marcos says he has no discussions with Solicitor General Jose Calida over plans to file quo warranto petition vs Leonen. Says Calida is not a supporter of his.

Calida headed Alyansang Duterte-Bongbong (AlDuB) which pushed for Duterte-Marcos tandem in 2016 polls.
Asked to react to a Manila Times report that Marcos and SolGen will “join forces” to seek inhibition of Leonen, Marcos says “ask SolGen what his plans are.”
Marcos faults media for playing up Comelec’s dismissal of failure of elections cases in ARMM, saying these are irrelevant. But it was Marcos who raised findings of Comelec division in local case that there was massive fraud in 2016 polls. Marcos’ spox Vince Rodriguez clarifies.
Comelec had said in its comment filed with PET that the Abdusakur Tan case was not resolved on the merits but dismissed due to mootness which mens Comelec did not resolve its validity, merit and probative value. Marcos insists finding of Comelec division still stand.
Rodriguez believes there is enough time for PET to resolve Marcos’ election protest. Wants PET to adopt findings of a Comelec division on alleged fraud. Says they asked for Leonen’s inhibition to avoid delay.
UP constitutional law Prof John Molo:
If Justice Leonen's dissent in the Marcos Burial case is a ground to inhibit him, then the same should apply to the words of the ponente and those who joined the decision to allow the dictator to be buried in the Heroes Cemetery.
Molo on Bongbong Marcos using Leonen's dissenting opinion in the Marcos burial case to seek his inhibition in PET election protest: Justices should be free to reason and write without fear of future harassment. (2/2)
VP Leni Robredo’s lawyers hit back at Marcos: Face reality. Vice President Leni Robredo won. Twice.

Pagod na kami na hanggang ngayon, pagkatapos manalo sa eleksyon at sa recount, patuloy pa rin ang panggugulo at pagsisinungaling ni G. Marcos.
Office of the Solicitor General also files own motion seeking to inhibit SC AJ Marvic Leonen from Marcos PET election protest, raising similar arguments that Marcos raised.
SolGen invokes 'tribune of the people' mandate to justify siding with Bongbong Marcos instead of a government body like Comelec. SolGen had previously sided with Marcos over shading threshold issue, leaving Comelec to defend its own decision to employ 25% threshold.
Lawyer Emil Maranon III, one of VP Leni Robredo's lawyers, earlier asked what standing does the SolGen have in seeking Leonen's inhibition when it is no longer Comelec's lawyer?

See how Bongbong Marcos' arguments are echoed by the Office of the Solicitor General.

In arguing Leonen's supposed bias against the Marcoses, both cited the same paragraph from Leonen's dissenting opinion in the Marcos burial cases.

Left: BBM
Right: OSG
Marcos raised as 1 of his arguments the issue of Leonen's previous appointment as chief negotiator with MILF and how Marcos blocked Bangsamoro Juridical Entity. OSG raised this same issue as part of factual antecedents.

First 2: BBM
Last 2: OSG
Marcos cited the 2-part article in The Manila Times discussing Leonen's "reflections" urging fellow-magistrates to dismiss PET election protest. OSG quoted both articles in full. Both argue: Whether true or not, a tribunal/judge must appear impartial.

First 2: BBM
Last 2: OSG
Both Marcos, OSG cite delay in resolving PET election protest--Marcos invoking New Code of Judicial Conduct, public policy; OSG claiming doubt on Leonen's impartiality, apart from other laws. Both say: Justice delayed is justice denied.

First 2: BBM
Last 2: OSG
Marcos earlier denied having knowledge that the SolGen will "join" his bid for Leonen's inhibition.
One other ground OSG cited vs Leonen is his supposed mishandling of Imelda Marcos’ dollar-salting case which ex-SolGen Frank Chavez elevated to SC. OSG says Leonen did not discuss Imelda’s rights despite Leonen affirming her acquittal and faulting prosecutors.
Ironically, in the same case OSG cited vs Leonen, SC said: This Court will not require a judge to inhibit himself in the absence of clear and convincing evidence to overcome the presumption that he will dispense justice in accordance with law and evidence.

Fides Lim, KAPATID spokesperson, criticizes the Supreme Court for long wait on petition for release of prisoners, only to refer it to lower courts: Pinaghintay niyo kami at binigo.
Lim to SC: We continue to appeal -- do not stand in your own way. Chief Justice Peralta, you have 2 more years to be true to your own words about our petition.

Lim was referring to Peralta's previous statement in a press release that detainees are presumed innocent.
Lim says they will pursue writ of kalayaan as suggested by SC Associate Justice Marvic Leonen in his separate opinion.

Lim: The Peralta court is provided with remedy with writ of kalayaan. Prove it, don’t be a passive court. Be a humane court.
