🚨NEW/WOW: At a hearing this morning in my/@BuzzFeedNews & CNN #FOIA lawsuit for FBI 302s from the Mueller probe, Judge Reggie Walton said Judge Sullivan could potentially find that the pardon issued to Michael Flynn is invalid because it is too broad in its language.

Our great #FOIA attorney @mvtopic & CNN's attorney asserted at the hearing that the govt needs to reprocess and produce the Flynn 302s that were withheld now that he has been pardoned. DOJ agreed to do that and we will have it by January 15

🚨NEW: Judge Questions Whether Trump’s Pardon of Michael Flynn Is 'Too Broad'

U.S. District Judge Reggie Walton said Emmet Sullivan could find that “the wording of the pardon is too broad, in that it provides protections beyond the date of the pardon.”

These comments this AM about the Flynn pardon from Judge Walton came unexpectedly in our #FOIA case for FBI 302s from the Mueller probe. Walton rejected govt's proposal that Flynn 302s be produced in Feb saying he wants it out "while this administration is still in office.”

BREAKING: DOJ just turned over the last set of typewritten FBI 302s from the Mueller investigation --46 heavily redacted pages - in response to my/@BuzzFeedNews & CNN's #FOIA lawsuit. We pried loose more than 5K pages over the past 13 months #MuellerMemos
buzzfeednews.com/article/jasonl…
Now the Justice Department has to start processing and producing to us all the supporting material -- handwritten notes, memos, emails -- that accompanied the 302s. Government attorneys have already indicated there are more than 20K pages.
The Justice Department withheld this sliver of information from an FBI 302 from Mueller's probe it just turned over to me citing b7a, which is ongoing investigation.

Some Michael Flynn and Trump memories courtesy of FBI 302s we obtained via #FOIA

That time Donald Trump was very upset with Michael Flynn in 2017.

Trump promised Michael Flynn a "good recommendation" after he was fired

An amazing email that took me 7 yrs to pry out of GTMO via #FOIA

In Jan 2013, a guard in a watchtower shot non lethal rounds at detainees. The watchtower was referred to as "Shotgun Towers." Guards were told not to say that b/c it could end up on the internet

Now it has Image
This email was clearly overclassified. There is nothing in it that would raise to the level of SECRET/NOFORN. It's just that it was politically sensitive as the email states and Guantanamo brass feared blowback
I wrote about this incident, which preceded a mass hunger strike at Guantanamo in 2013.

Under the Presidential Records Act, Presidential records are automatically transferred into the legal custody of the Archivist as soon as the president leaves office

The public can #FOIA those docs after 5 yrs but the president can invoke exemptions to keep secret up to 12 yrs
Interestingly, Biden vice presidential records will be subject to #FOIA on Jan. 20, 2022.
The PRA "establishes procedures for Congress, courts, and subsequent Administrations to obtain 'special access' to records from NARA that remain closed to the public, following a privilege review period by the former and incumbent Presidents"

🚨Hours before Election Day, DOJ releases 13 secret pgs of Mueller's report in response to our #FOIA lawsuit that contains revelatory details about the probe into Asaange, WikiLeaks, Stone re: DNC hack & decisions not to charge them

@kenbensinger & me
buzzfeednews.com/amphtml/jasonl…
The newly visible sections, found in the table of contents as well as on pages 9, 51, 65, 174, 176-179, 188-189, and 190-191, deal almost entirely with charging decisions by members of Mueller’s team regarding the hacks and WikiLeaks’ publication of the stolen emails.
The newly unveiled sections also include a small but noteworthy revelation previously redacted due to an ongoing investigation regarding Russian attempts to hack a company that makes voter registration software. The name of the company, VR Systems, had been redacted until now.

TOMORROW: After 1.5 yrs of litigation, DOJ w/be unredacting at least 15 pages of key sections of Mueller's report in response to my/@BuzzFeedNews & @EPICprivacy's #FOIA lawsuit

Relates to WikiLeaks/DNC email hack/Trump's campaign's interest

BACKGROUND: buzzfeednews.com/article/jasonl…
ADDITIONALLY: Tomorrow, @BuzzFeedNews and I and CNN will receive another production of FBI 302s (witness interview summaries) from the Mueller investigation in response to our #FOIA lawsuits. #MuellerMemos
We have been aggressively fighting for the release of documents for nearly 4 years with more than three dozen #FOIA lawsuits filed against multiple govt agencies. PLEASE support our sunshine efforts.
