1/Scathing @DeptVetAffairs OIG Report issued today on how VA leadership mishandled investigation into sexual harassment of our client @AN_Goldstein, decorated Navy vet.

Really sad to see victimization of victims. Statements to follow.

va.gov/oig/pubs/VAOIG…
2/Statement of Andrea Goldstein (@AN_Goldstein)
3/Statement of Mark S. Zaid, Attorney for Andrea Goldstein
4/Findings of VA OIG investigation:

1. The OIG Cannot Substantiate that Secretary Wilkie Investigated or Asked Others to Investigate the Veteran

2. Senior VA Officials Questioned the Veteran’s Credibility, and VA Police Initially Scrutinized the Veteran
5/

3. Multiple VA Officials Testified that Secretary Wilkie Remarked that the Veteran Had Made, or May Have Made, Prior Similar Complaints

4. VA Officials Attempted to Focus the National Media on the Veteran’s Background and Credibility
6/

5. VA Leaders Did Not Fully Consider or Take Appropriate
Administrative and Other Corrective Actions Despite Having Access to Relevant Information
7/OIG Conclusion is worthy of posting in full:

"The evidence is replete with examples of VA senior leaders undertaking defensive actions and engaging in confrontational messaging while failing to recognize the need to take corrective action to address known problems....
8/...Secretary Wilkie and other VA officials privately disparaged the veteran, with the Secretary referring to her as “the Takano staffer whose glamor shot was in
the New York Times.” The tone set by Secretary Wilkie was at minimum unprofessional and at worst provided the basis
9/...for senior officials to put out information to national reporters to question the credibility and background of the veteran who filed the sexual assault complaint.
10/This report details the statements and conduct of senior VA leaders that appear to undermine
VA’s stated goals of providing a safe and welcoming environment for all veterans and to treat
complainants of sexual assault with respect.
11/VA leaders failed to make meaningful efforts to
determine what corrective measures may be needed in response to the sexual assault complaint, while engaging the media to focus on the complainant. Together with statements made by Secretary Wilkie and other leaders, ...
12/...this approach points to a lack of genuine commitment by senior leaders to address the serious issues raised by the veteran’s complaint. The OIG is not making any formal recommendations for the reasons outlined in each section of the report,...
13/...but will continue to monitor VA’s progress in addressing proposed actions as to the contractor and
any administrative actions VA deems appropriate on other issues identified by the OIG."
END/Also worth noting how @RepDanCrenshaw/@DanCrenshawTX refused to cooperate w/VA OIG & stayed silent on the criticism directed at him. What he did behind the scenes was deplorable & unfitting a Member of Congress.

Mark Zaid, Goldstein's attorney, told Newsweek in a statement that Crenshaw's "silence says it all."

1/At least 1,500 lawyers, retired judges, law professors, DOJ alumni - two former presidents of @ABAesq among them - have called for bar associations to condemn Trump campaign lawyers and to investigate their post-election conduct.

I signed. Here's why.

lawandcrime.com/2020-election/…
2/My decision pertained to recent comments made by Trump attny Joe DiGenova that @C_C_Krebs should be “drawn and quartered” and “taken out at dawn and shot.”

DiGeova later said his comments were in "jest". I unequivocally reject that excuse.

3/Lawyers have responsibilities that extend beyond the interests of our clients. We are held to a high standard to ensure we advocate for the interests of justice, and that certainly means we refrain from rhetoric or vitriolic statements that could bring harm to a third party.

49 years ago yesterday #DBCooper successfully perpetrated the most famous unsolved skyjacking crime. Or did he? I provided legal counsel to cold case team that believes we solved the mystery.

Tonight, I'm discussing new @TheHisotry program on case.

2/ I've worked this case for several years. Our cold case team incl experts in law, law enforcement, forensics, cryptology, journalism & other relevant areas. First hand witnesses were interviewed & we were regularly in touch with @FBI.
3/I had no idea @TheHisotry was producing program. No one connected to it reached out to our cold case team, which was more than 40 people.

There are many theories abt hijacking & I was surprised they didn't contact us if only to compare notes. Our efforts were high profile.

On this date in 1963, President John F. Kennedy, who was struck down by an assassin's bullet three days earlier, was laid to rest.

1/My client, a Navy veteran sexual assault victim, was subject of high level political smear attacks that led to firing of Deputy Secretary @DeptVetAffairs, who has now gone on record.

Now Congressman @DanCrenshawTX (R-TX) is slandering victim. Why?

newsweek.com/former-veteran…
2/@RepDanCrenshaw claims "she had filed six complaints while they served together in the Navy". FALSE.

Do you have proof to contrary Congressman? Let's hear it.

Why does it even matter if she filed even one complaint? What are you insinuating? That she files false reports?
3/That she exaggerates? That she creates situations as a victim? Is that what you are alleging about a sexual assault victim who actually works alongside of you in Congress? Do you really think your statement helps victims be comfortable in coming forward to report assaults?

No one should be treated like this, regardless of ideology. Culprits should be arrested & prosecuted.

But don't necessarily believe what could be propaganda by alt-right as other incidents allegedly involving BLM & Antifa (not an org) turned out to be right-wing agitators.
"In some cases, they have been found to purposefully sow confusion by impersonating left-wing activists in an effort to fuel movement toward civil war."

1/Several years ago I handled prepublication review case of former @CIA engineer who participated in #ProjectAzorian & he published "The CIA's Greatest Covert Operation: Inside the Daring Mission to Recover a Nuclear-Armed Soviet Sub".

Fascinating story.

END/ His book & story is now featured in documentary film released yesterday called "Neither Confirm Nor Deny".

I highly encourage everyone to watch. And @IntlSpyMuseum should consider airing the film in a future event!
