#BombayHighCourt is hearing the plea filed by ARG Outlier parent company of Republic TV challenging the FIR filed in the TRP scam case implicating the channel.
The matter came up in the first half of the court session when the lawyers appearing for ARG Outlier sought for an adjournment so that Sr. Adv. Harish Salve can appear for Goswami through video conferencing tomorrow.
Bench of Justices SS Shinde and MS Karnik hearing the plea asked the lawyer to seek everyone's consent for VC and come at 2.30 pm.
When the Bench took up the matter, Sr. Adv.Aabad Ponda appearing for ARG argued that he seeks to make submissions for urgent reliefs.
Court reminds him that it was his lawyer who was seeking adjournment to tomorrow.
Ponda: Milords there is some urgency. In any case Sr. Adv. Kapil Sibal is anyways not free till January 6, 2021.
Chief PP seeks for time as he was under the impression that a sr counsel was representing the State.
Court: If the petitioner is pleading urgency we cannot not hear him.
Ponda: Milords I am making a solemn statement that the Maharashtra Police has reached Delhi to arrest them. I bave received a message at 2.30 pm. It is there on my phone.
Ponda: I am only seeking that they should not arrest me till tomorrow. These are non-accused milords.
Court: Mr. Thakare why the non-accused?
Ponda read out from the chargesheet to point out that Mumbai Police had mentioned the "Republic Channel, maalak, chaalak ani sambandhit vyakti" (republic channel, owner, managers and related persons). This could mean anyone.
Court asked Ponda to name the people.
Thakare also objected to Ponda's prayer saying there cannot be a blanket order as the other people except the two petitioners are not party to this case.
Ponda added that they have crossed all limits there is gross illegality.
Justice Shinde asked Thakare if chargesheet has been filed then it is presumed that investigation is completed.
Shinde: the maalak, chalak words are so broad itnmay include anyone, even reporters on field. Why don't you take instructions of no coercive action till tomorrow? No one is stopping you from investigating.
Thakare seeks for sometime to take instructions.
Chief Public Prosecutor states that no coercive steps will be taken against persons referred to in running page 21 of the chargesheet filed by Mumbai Police in the TRP case till tomorrow.

ASG: Milords had this been physical hearing, I would have located them, it is difficult during virtual hearing.

Court states that the officers of ED are willing to come to Mumbai to carry out interrogation and they can proceed with the interrogation subject to the outcome of the plea.
