#BombayHighCourt begins hearing plea of #BhimaKoregaon accused #varavararao raising grievance against violation of his fundamental rights by not providig adequate medical facilties to him.
Additional Solicitor General Anil Singh begins by submitting that Rao was in hospital and now as per the hospital he can now be discharged.
Court indicates that they want to hear the plea finally.
ASG pointed out that the reliefs sought by the petitioners are on medical grounds.
ASG: They had filed medical temporary bail in Sessions Court which was not granted. So they challenged the same here.
The new plea has raised additonal grounds with different facts which they should raise before the sessions court first.
Court: Mr Singh under Art. 226 this court is not bound by the prayers in the petition.
The Supreme Court in Goswami's judgment has also held that the hogh court has wide powers under Art. 226.

Court: Now it has been made clear by the SC that interim bail can be granted u/article 226 which was earlier a grey area.
Court asks ASG to let the petitioners begin with submitting their plea.
Sr Adv Anand Grover appearing for Pendyala Hemlatha, wife of Dr. Rao begins his submissions.
Grover: Rao bas been charged in 24 cases and he has been acquitted in all 24.
He has never shied from appearing in the trial and was never absconding.
Grover apprises the court that they have applied for clone copies and records to be produced.
We have still not been granted he copies.
ASG intervenes stating that the arguments on merits for bail has been rejected till ghe Supreme court and should not be argued again.
Grover: under the law I am supposed to do some things.
Grover points out that he is arguing for statutory bail.
After Court asks ASG to clarify, ASG points out that the bail was rejected on merits. However they are arguing for medical grounds.
ASG: in fact in their petition, they have mentioned that they are oy seeking on medical grounds.
Grover points out from the list if dates the facts in the plea.
Court interjects Grover and asks how much time will he take to finish his submissions.
Grover and Sr. Adv. Indira Jaising appearing for Rao mention that they will take 1 hour each.
Court: Ok then we propose to hear the matter on virtual hearing as they (Sr adv) are seniors.
Grover: milords have fixed so many matters at 4 today, I don't know how milords are managing so many matters.
Court: we hear all matters we can. Simple.
So then we will hear the matter on Monday, just the earlier statement will have to continue, we cannot stop the hospital in the middle.
Court adds that the state will have to continue bearing the cost.
#BombayHighCourt continues the earlier interim order granting Rao's stay in Hospital till the next date.
Court will continue hearing the plea by Rao's wife on Monday 21, 2020.
