During his April 2004 confirmation for the DC Circuit, he told Senator Durbin that FedSoc “does not take position on issues. It does not have a platform.”

Kavanaugh’s response seems disingenuous, as ten months before he made that statement to Durbin under oath, he’d received an email—at his White House account—from FedSoc’s Joel Pardue. The subject was “Tasks.”

The tasking was directed by the Federalist Society, and was part of the organization’s campaign to confirm one of George W. Bush’s judicial nominees.
FedSoc’s Pardue and C. Boyden Gray had tasks—as did Brett Kavanaugh.

Kavanaugh was to “designate 24 people from media outreach list who would attend confirmation hearings.” Others were to engage right wing policy groups—Focus on the Family, Family Research Council, Americans For Tax Reform—behind the nominee.
This seems like a “platform.”

Brett Kavanaugh was well aware of FedSoc’s engagement of right wing “family policy groups” to advance their judicial nominees. He was tasked by FedSoc, from his position within the Executive Office of the President, to assist them.

From another Kavanaugh document production, a 2003 email to Kavanaugh regarding “priority seating” for VIPs, including Leonard Leo, C. Boyden Gray, and Jay Sekulow.
This seems well outside the description of FedSoc that Kavanaugh provided to Dick Durbin.
Digressing a bit, but C. Boyden Gray’s a longtime friend of Susan Collins and a contributor to her campaigns. He opposed Trump’s impeachment, and his firm represented John Solomon in a lawsuit against the Department of State to acquire Hunter Biden-related records.
Shorter: Kavanaugh knew who the Federalist Society was aligned with regarding judicial nominees, and he actively helped the organization from the White House. The description of the organization he provided in his sworn testimony contrasts sharply with the apparent truth.

Lindsey Graham’s is the only principal committee for a Senate campaign that Burck’s contributed to during the current cycle. The optics here aren’t good.
