OK - now in EDNY, hearing in US v. Douglass Mackey, a.k.a. “Ricky Vaughn,” charged with conspiracy against rights, before Judge Nicholas G. Garaufis. Inner City Press is covering the case innercitypress.com/edny1mackeyicp… and will live tweet, thread below.

Judge Castel: I have reviewed letters from the defendant's family, friends, and others.
Defense lawyer: Mr. Hernandez wants the Court to know that he is not prepared to go forward today.
Judge Castel: The jury convicted him in October 2019. It has been delayed.
Judge Castel: The time has come for the defendant to be sentenced. He has had in hand the pre-sentence report since February 12, 2020 - over a year ago, and before the shut down of the pandemic. I am not inclined to adjourn the sentencing further.

Juan Manuel Avila Meza's lawyer: OK, he showed up at a meeting. But he surrendered voluntarily at the US Embassy.

Defense: Mr. Avila was never posted to cities through which drugs were moving. He has confessed guilty, but there is duress - not a defense, but relevant. He is trying to do what he can: he went to the DEA and said, I am here.

AUSA says Secor was planning to flee.
Judge Trevor N. McFadden cuts in: You mean where he says, even if I go away, if they want me, they'll get me?
AUSA: He told agents about fleeing to Oregon. He has access to money from several sources.
AUSA: Secor has made purchases at gun stores. And he has only one registered fire arm. In California one can manufacture one's own gun - but then must take it in to register it.
Judge: Is that different than in Virginia?
AUSA: My understanding is limited.

Looks like it's going to be a verdict - Judge Rakoff just spoke to the lawyer about rules involving speaking to jurors after the case is over.

Judge Mehta: I hope DOJ is looking into the propriety of the 60 Minutes interview... No matter how much press this case gets, the defendants are entitled to a fair process. These statements could impact the jury pool. The government should know better.
Judge Mehta: Read local criminal rule 57.7, which governs public comments on pending criminal cases. I intend to vigorously enforce it. DOJ needs to understand these statements can impact the rights of defendants. I will not tolerate this.

EDNY Magistrate Judge Sanket J. Bulsara: Ms. Carpenter, you were arrested on a D.D.C. warrant. Do you want an identity hearing or a preliminary hearing?
Federal Defender: She waives both.
AUSA: We are not seeking detention, given Ms. Carpenter's cooperation to date with the investigation and her self-surrender today. She gave her passport to the FBI this morning.
