The South Florida public defenders say they are not prepared to do the arraignment today. They says Speedy Trial Act claim has not begun, as he's not in the District and he not been arraigned yet. Asks for delay in arraignment.
Judge Nichols: Sounds fine.
AUSA: OK
AUSA: He's scheduled to move from Oklahoma (transfer station) to DC next week.
[Note: movement of Federal prisoners, for example from Florida to DC, goes through Oklahoma... This has come up in @sdnylive cases]
Public defenders: We hope to file a bail review motion by May 7. We couldn't locate him at first. We'd like you to stay his transport to DC for the next 30 days - we can call him in Oklahoma.
AUSA: We oppose him remaining in Oklahoma. It's a temporary facility. The Marshals contract with local facilities. He cannot stay there long term. Counsel could call him in DC, even video. Chief Judge Howell's case was different - he was arrested in NJ
AUSA: Here, Harris was arrested on March 18 in Florida, had a hearing on March 25. We don't know when he was transferred to Oklahoma.
Public Defender: We were not the lawyers who represented him in Florida. So then we had to find him in Oklahoma.
Judge Nichols: Isn't between now and May 7 the most important time?
Public defender: If he's detained after that, we might ask to have him move to Florida, to be near us.

Judge Nichols: I have experience with Federal Transfer Center in OK, I know if they say he'll move May 8, who knows when he'd arrive in DC.
Judge Nichols: I'd like to know how long he's been in Oklahoma.

Judge Nichols: So he must file a bond motion, if any, by May 7. US by May 14. Optional reply May 17. I'd like to hold a hearing on May 18, 2 pm. And we could arraign him then, too. We will paper the appointment of counsel.
AUSA: We may seek a protective order
Judge Nichols: Anything else? No?

The sentencing judge is Richard J. Sullivan. He's now on the 2d Circuit Court of Appeals, but still handles cases he had when he was elevated to the appeals court. He asks the US Attorney's Office if there are any victim who wish to speak in today's proceeding.

Judge Castel: I have reviewed letters from the defendant's family, friends, and others.
Defense lawyer: Mr. Hernandez wants the Court to know that he is not prepared to go forward today.
Judge Castel: The jury convicted him in October 2019. It has been delayed.
Judge Castel: The time has come for the defendant to be sentenced. He has had in hand the pre-sentence report since February 12, 2020 - over a year ago, and before the shut down of the pandemic. I am not inclined to adjourn the sentencing further.
