Nagpur Bench of #BombayHighCourt is hearing the suo motu PIL registered to consider issues concerning #COVIDー19 management in #Nagpur and other districts under their jurisdiction.
Court notes that they have received 23198 vials of Remdesivir. Directions are issued to send this deficit immediately as per the Central government order.
Court: There is a reason for us to believe that supply orders must have been placed much before April 21, and thus these over 20k vials which they have received is not part of the 4,35,000 vials alloted by Centre.
Court: The state has to now take efforts to procure the vials which has been allowed.
We hope that they will do so at the earliest.
The concerned officer should issue district wise allocation order to ensure each district is equitably distributed.
Court notes that if State and district authorities do not take measures that they are expected to take, then the same would amount to failure to do their fundamental duties.
Court directs the State to submit Remdesivir vials to specific districts of Maharashtra which have not received vials for the last few days.
Court directs the nodal officer to issue the district wise allocation order.
Court notes that private purchases of the medicines is being permitted contrary to what has been submitted to them by the officers. Court directed the officer to ensure he does not make such irresponsible statement else the Court will take appropriate action.
Court notes that there is blackmarketing of the drug apart from the shortage of drug. The hapless situation of COVID patients is exploited to the fullest.
Court opined that it was best for the Court to stop allowing private parties to place orders for COVID drugs.
