Sr Adv Darius Khambata submits that the petition will now become infructuous as the DGP Sanjay Pandey who is accused in the plea has recused himself from the investigation and a fresh inquiry has been issued.

Court (to Punamiya): We had expressed in the previous hearing also. This a service matter. This should be raised before the concerned authority. There is no point in keeping petitions pending. Fresh petition can be filed based on new cause of action if any arise.
