#BombayHighCourt to deliver verdict in plea filed by Mumbai resident Sunaina Holey for quashing FIR registered against her pertaining to tweet allegedly promoting enmity between two communities.
Pronouncement by Bench of Justices SS Shinde and MS Karnik @ 1.30pm.
Order: Assuming that the said tweet is an extreme view in retaliation of the expression in crowd, the said tweet is yet to be judged from the mind of a strong prudent man.
Order: Neither community nor religion is named. If test of strong or prudent person is applied said tweet cannot be said to have created hatred between community or show the petitioner has mens rea.
Order: The efforts of police are appreciated to ensure situation does not go out of hand. The action registering FIR if taken at face value do not constitute an offence. After careful and indepth consideration, we deem it fit to quash FIR.
Sr Adv Mohite requests for a stay on the order for sometime to study the order and take appropriate steps.
