Breaking: #SCOTUS grants three new cases, including Dobbs v. Jackson Women’s Health, a challenge to Mississippi’s 15-week abortion ban. (Second image is from the petition, from which the court will be considering Question 1: the constitutionality of the ban.)
Here’s the docket for Dobbs: supremecourt.gov/search.aspx?fi…
Here’s the full orders list: supremecourt.gov/orders/courtor…
Shinn v. Ramirez is a state-side petition in a capital case — as in, the state lost below — and it’s an AEDPA case out of the 9th Circuit, so, not knowing much more, that grant is going to be of concern to the criminal defense bar. Docket: supremecourt.gov/search.aspx?fi…
The first #SCOTUS decision is in Edwards v. Vannoy, and the court holds that Ramos, which struck down nonunanimous criminal juries, is not retroactive on federal review. Kavanaugh writes for the 6-3 court; Kagan writes for the dissenters: supremecourt.gov/opinions/20pdf…
The second #SCOTUS decision is in BP v. Mayor & City Council of Baltimore. BP wins in a case about federal court removal from state court in a case relating to environmental impacts. Gorsuch writes the 7-1 decision. Only Sotomayor dissents. Alito recused. supremecourt.gov/opinions/20pdf…
The third #SCOTUS decision is CIC Services v. IRS. The IRS loses (on Tax Day, ironically enough). Kagan has the opinion for a unanimous court. supremecourt.gov/opinions/20pdf…
Still at least one more opinion coming.
The final #SCOTUS opinion today is in Caniglia v. Strom, protecting against the warrantless taking of firearms from the home under a “community caretaking” exception. Thomas has the opinion for the unanimous court. supremecourt.gov/opinions/20pdf…

Raise your hand if Guy Pearce aging is a personal attack on your understanding of the world.
I mean.
I still love him, don’t get me wrong. I just can handle it better if I think of them as two totally different people. 🙃

This is a majority opinion by Judge Brasher limiting application of the First Step Act. The 11th Circuit ruling conflicts with every other appellate ruling — including ones from the 2nd, 4th, 5th, 6th, 7th, 9th, 10th circuits, per Berman.
Brasher is a 39-year-old former Alabama SG who was nominated to the 11th Circuit by Trump six months after he started work as a district court judge.
He was joined in the majority opinion by Judge Luck, a 42-year-old Trump appointee.

The dissent was from Judge Martin, a 65-year-old Obama appointee who was one of his first five appellate court nominees in 2009.

A very interesting "Proclamation on Peace Officers Memorial Day and Police Week, 2021" from Biden: whitehouse.gov/briefing-room/…
From the start, Biden acknowledges that police are being tasked with many jobs today, including "responding to incidents involving domestic violence, substance use disorders, mental health challenges, and homelessness."
Then, there's a bit that might track closer to an old-school Biden speech on cops.

So, unless I read this wrong, some timing elements here are left out or left intentionally vague:
* The story addresses "toll records ... from April 15, 2017 to July 31, 2017"

* ... "obtained" by the "Trump Justice Department."

* Reporters informed of this in a May 3 letter signed by current DOJ officials (ie, Biden DOJ).

When were they sought? When obtained? Unclear:
Does "it" mean they were sought in 2020? Obtained in 2020? Both?

The story also leaves unclear whether whichever of those it was (were?) happened under Barr, or after, under Rosen?

Today at the 9th Circuit, @chasestrangio will be arguing in the Idaho anti-trans sports ban case, Hecox v. Little. The plaintiffs won an injunction below.

The judges are currently on the 2nd of 4 arguments. Hecox is the 4th. You can watch it here: ca9.uscourts.gov/media/view_vid…
They're starting on the third case now, which, given the time allotted, means the Hecox arguments should be beginning around 5:15p ET/2:15p PT.
The Hecox v. Little arguments are beginning now: ca9.uscourts.gov/media/view_vid…

One hundred days ago, Donald Trump was ending his time in office, but Tim Scott starts off his speech by saying Biden is divisive. OK.
Tim Scott continues trying to sell Biden as divisive.

“Families get to define [the American Dream] for themselves,” Scott says, opposing ... more schooling availability for all Americans.
Scott is most effective, rhetorically, on policing, race-based discrimination, & voting — using his own experiences w/ racism to try to push back against Dem attacks on GOP policies/positions. It was an attempt to connect, but then he just went off into defensive talking points.
