Back in Magistrates Court @SDNYLIVE, 8 family members, 2 defendants both in yellow - Essex County jail again? 2 babies crying. All that's lacking is the judge. Thread below
Defendants surrendered to NYPD last night at 7: 30 pm. Drugs and guns. US wants both detained. First defendant consents; for 2d, Smith, there will be a bail argument.
AUSA: This is a presumption case.
Judge: Explain that to the defendant.
AUSA says defendant fired a gun on 184th Street in The #Bronx. Served a year, then arrested again. Cites "online persona, online loyalty to the group." Defense: Grandmother has a stock portfolio

Sentencing is getting a late start, as they moved people out of Judge Gardephe's courtroom, seemingly to make way for more SDNY prosecutors to squeeze in to watch. Three AUSAs at front table. Avenatti at the defense table behind.

Federal Defender: I'm not sure we're going to need a hearing for our pre-trial motions. We'd like a trial date.
Judge Hellerstein: I'll have to rule on your motions.
Judge Hellerstein: I'd like to rule on July 29.
AUSA: We could file early if the Court prefers.
Judge Hellerstein: Can you file by July 22, if you need an adjournment you can ask. There are trial in August and I'd like to get this done by then. Motions by July 9.
