OK - long #insurrectionBlues hearing on Brandon Fellows before DDC Judge McFadden. Fellows' lawyer says he wants to fire her. Inner City Press will from this point on live tweet, thread below. Song: soundcloud.com/innercitypress…
Fellows' lawyer says he should get another lawyer before he makes his own statement in court.
Fellows: I'd rather not wait.
Fellows: I'm willing to accept the risk. I'd like to make my own case.
Judge McFadden: Are you seeking to have another attorney?
Fellows: Previously I was willing to wait out a plea deal. Now, after reading laws, I think not. I've been hearing lies.
Judge McFadden: What I'd like to do is come back in a few days when we can find another attorney to represent you. If you still want to testify, you could do that. But if you're telling me that you're comfortable with her as your attorney, I'll consider that.
[It seems that for Fellow to speak today, which he wants to do, he has to keep his lawyer. So he's doing it.]
Now his lawyer (?) says she wants to speak off the record with the judge, lawyers only. Client can't go, in criminal case?
Judge McFadden returns from sidebar with lawyers only, not defendant Fellows, and says: Let's come back tomorrow... You taking the stand is a big deal. You are entitled to it. I want to make sure you understand what you're doing. 11 am tomorrow? In Courtroom 2
It's over, until tomorrow. While Judges seeking to protect defendants against self-incrimination is understandable (sometimes motivated only by desire not to be reversed on appeal), the right to speak is shown to exist only *on delay* - Pauline Bauer, Fellows

OK - now #XRP crypto case of SEC v. Ripple a proceeding before @sdnylive Magistrate Judge Netburn, on SEC trying to quash deposition of Hinman innercitypress.com/sdny10cryptose… Inner City Press asked IMF today about #BTC ElSalvador & Paraguay; will live tweet, thread below
Judge Netburn: I have before me the subpoena seek to depose former SEC official Hinman, and the SEC application to quash. SEC?
SEC's lawyer: If official have to testify, years after, it would have a chilling effect.
SEC lawyer: Let me cite again your Honor's decision in the 9/11 case. From Page 14 of your decision, you raised the issue of repetition and [wait for it] ripple effect. The burden on Ripple here is high, and they have not met it. Any questions?
Judge Netburn: Yes
OK - in #insurrectionBlues case of US v. Daniel Rodriguez, DDC Judge Amy Berman Jackson is holding a proceeding, US says it gave the defense 111 body-worn camera videos. And the public? Inner City Press will live tweet, thread below. Song: soundcloud.com/innercitypress…
Judge Amy B. Jackson: You say there are related cases, but the defendants did know each other, did they?
Assistant US Attorney: We would not make the representation at this point that they know each other.
Judge Berman: Let me read the 5f order about Brady material
Judge Berman: When will you made a plea offer?
AUSA: I'm not sure there will be an offer at this time.
Judge Berman: Even in the most egregious cases, the government makes an offer....
AUSA: We'll endeavor to have those conversations.
Judge Cooper: Mr. Robertson, we are here on the US motion to revoke your pre-trial release. There was a hearing before Judge Harvey on July 9. Now the motion is briefed, with new material today... I suspect we're going to hear he shifted it to a gun dealer...
AUSA: There's probably cause under 922(n) prohibits the receipt of firearms - he has been responsible for the transport and receipt. A third party doesn't help him.
OK - back to DDC #insurrectionBlues case of US v. Robert Morss before Magistrate Judge Harvey. AUSA is hammering away that he was going to leave the country. Inner City Press will live tweet, thread below. Previously:
Morss' lawyer: The US is using stills from a video --
[Note: DDC judges have yet to make these videos available to the public, only to a limited groups given the DC OUSA's password to USAfx. This is a scam]
Morss' lawyer: He is in the back, he passed shield back
Morss' lawyer: There are six defendants on this indictment and all but one have been released. All Mr. Morss wanted to attend was a historic event. Yes, it got out of hand.
OK - here @sdnylive, in case of accused CIA #Vault7 leaker Josh Schulte, now a "Faretta hearing" on whether Schulte will be allowed to represent himself for his second trial. Inner City Press will live tweet, thread below. Song: soundcloud.com/innercitypress…
Judge Crotty: Usually it's better to have a lawyer, especially on these charges. But the choice is entirely yours, as long as you make it in a knowing fashion. Think hard about it. If you decide to represent yourself, I will appoint stand-by counsel.
Judge Crotty: You do not have the right to reject the stand-by counsel.
[In DDC, #insurrectionBlues defendant Pauline Bauer was *asked* if she would accept stand-by counsel. Same issue arose there this morning with Brandon Fellows:
