The hearing in the Larry Elder and voter Betty Tom Chu matters (my firm represents the latter) may be seen here:
2/ Judge opens hearing with a tenative ruling that the tax return disclosure requirement doesn't seem to apply to recall elections, and if it did, Larry Elder substantially complied with it.
3/ Elder's lawyer Steve Baric says even if the statute applied, Larry Elder's alleged sin was providing seven pages of COMPLETE documents to the SOS, but those documents were not in the pile of hundreds of pages of redacted documents. He complied with the statute.
4/ Elder provided over 300 pages of personal AND CORPORATE documents to the state. Also redaction portion of the statute is there to protect the CANDIDATE's privacy, why does the state care? Form over substance.
5/ Betty Tom Chu's lawyer, my colleague @MarkMeuser, says the court's tentative covers the matter, and he will respond if necessary. State's lawyer arguing now first trying to argue that recall election should be run the same way as other elections.
6/ SOS lawyer is claiming that the stacks of tax returns Elder provided -- one seven pages shorter than the other -- so the literal letter of the law is not met. SOS seems to be now saying if Elder resubmits the 7 pages, it will be fine.
7/ Judge pushes back on interpretation of Election Code Section 1189.2 -- Tax returns would have to have been filed weeks ago to meet the literal language of the statute the SOS claims applies -- it makes no sense and it isn't consistent with a recall election.
8/ SOS attorney Russell argues is SOS is trying to hold the recall election in as close as possible a way as a regular election. Counsel for Elder and Chu echo court comments and stand on their position that the tax returns are NOT required in a recall election anyway.
9/ Court rules the tax return obligation should not have been required. Thus the SOS is ordered to include Larry Elder on the ballot.

(Thread 1/4): With @Varneyco on @FoxBusiness - This political hit job against @POTUS45 is the kind of third world nonsense we see in countries like #Pakistan where former presidents are taken down using petty offenses. Well beneath the dignity of New York prosecutorial offices.
(2/4): #Arizona's voting limits do not violate the voting rights act nor do they hurt minorities. Ballot harvesting hurts every #American equally. The 9th circuit got this one wrong. I am thrilled to see this victory for #Election integrity.
(3/4): #Florida's social media law was struck down in part because of vague language. I found the exceptions for Florida based companies like @Disney and @comcast to be a little dubious. With some more work and wordsmithing this could become a great law.

(Thread 1/4): With @TuckerCarlson on @FoxNews tonight - Our government regularly flouts modern security laws established in 1947 & since. They justify spying on #Americans in the name of targeting foreigners and classifying any #American data they scoop up as “incidental”.
(2/4): Under current law, the @NSAGov can go shopping through a treasure trove of phone company data w/little oversight. Once they have your information, faceless, unelected bureaucrats are free to pass it around the office
(3/4): Even if you can prove you are being spied on, there is no legal recourse. No lawsuits against the @NSAGov have effectively been successful in stopping the spying on a particular #American citizen. Cases can last for over a decade.

Some lawyers have said John McAfee didn’t kill himself — is that disbarrable? It’s a comment on the administration of criminal justice involving US federal charges.
Some lawyers are arguing regarding January 6 that their clients are innocent while the government claims they are guilty. If the clients are convicted, or the facts advanced not accepted, should the lawyers be disbarred? Suspended while the bar figured it out?

Hiring thoughts 💭 1/ As a lawyer with over 15 years of hiring & management experience, credentials matter, but only as one factor. I would rather hire the best graduate from a mediocre law school than a middle-achiever from the top 10. A clerkship is a great credential...
2/ Most law graduates do not write well enough for law firm standards/client needs; they have zero training on how to deal with clients/opposing counsel/witnesses. Street smarts & people skills are more important in daily practice than your Intersectional Law of the Sea grade...
3/ These days too many students/young lawyers approach interviews with a "me me me" centered approach, as opposed to "how I can bring my skills/experience/attitude/work ethic to your business and help YOU succeed/take things off your plate." Emotional intelligence is important.
