ALERT: Court schedules emergency hearing in Jan 6 case of Dan Goodwyn, possibly to order him jailed until trial
Goodwyn is accused of refusing to meet w/ pretrial services, refusing to wear mask at meetings and playing "word games" w/ court employees
And there was this! -->
Goodwyn is accused of being a member of the Proud Boys who breached the Capitol on Jan. 6.
In charging documents..... feds allege Goodwyn used Trump picture for his Twitter profile pic... and promoted "Stand Back & Standby"
Defense attorney says "Goodwyn cannot wear a mask.. and is not into vaccines"
Goodwyn is trying to avoid being thrown back into jail for failure to follow court restrictions
Defense lawyer: Goodwyn is being asked to do things that, from a mental health standpoint, he can't do
Defense attorney: For Jan 6 defendant Daniel Goodwyn, wearing a mask "is like torture"
Judge is now yelling at defense lawyer. "We have a pandemic!"
Judge threatens to hold defense lawyer in this Jan 6 case in "contempt" for not stopping his argument about masks/vaccine, when judge tries to interject
There's likely a phone connection issue, this is a virtual hearing
This is ... quite something. This Jan 6 defendant is poised to be thrown back in jail for his ongoing refusal to wear a mask or get vaccinated. Judge is irate.
Standby for updates
Defense lawyer acknowledges Goodwyn is not vaccinated and tells judge that Goodwyn will "flip out" if he has to wear a mask.
Judge: "He's putting other people's lives at risk"
Judge can throw this guy in jail...
Defense lawyer: "(Goodwyn) can do things remotely, by zoom"
Judge: What happens when he has to come to court?
This is the angriest I've heard any judge in any Jan 6 case so far. Easily
Wow
Defense lawyer called pre-trial services worker "arrogant" and "prissy"
Judge is now screaming at defense lawyer. Both defense lawyer and client might end up in jail in this Jan 6 case by end of the day (Judge has threatened possible "contempt" finding today)
Vaccine/mask hesitancy is playing out during this court proceeding
But this is different than in the rest of America. The judge can throw this defendant in jail if an agreement isn't reached.
Still going....
Judge keeps asking defense lawyer "What happens when (Goodwyn) has to come to court?
Defense lawyer isn't directly responding. Lawyer is making clear Goodwyn "is not a fan" of masks or vaccines
Defense attorney is arguing Goodwyn is (or was) on autism spectrum. But defense is not producing paperwork
Judge: "At some point he's gonna be in the courtroom in Washington and he's gonna have to have some way of protecting himself.. and other people"
Judge is now directly asking Goodwyn "What's the problem with wearing the mask?" ("Lives are at risk")
Goodwyn: "It stresses me out"
Judge: "You're coming into contact w/ people who could die as a result of you having the virus"
Goodwyn: "Respectfully I disagree"
Judge: "600,000 have died. I don't care if you agree... I'm not gonna be part of other people dying, because of what you don't believe"
Goodwyn: "There is not any proof of asymptomatic transmission. There's no proof wearing a mask would prevent it"
Judge: "When did you go to medical school?"
Judge tells Goodwyn & defense attorney he's gonna need some type of medical note or record about risk of wearing mask
*** Court now orders competency exam ***
Goodwyn is ordered to wear a mask during "home visits" by pre-trial services/court
Goodwyn says "I'm not gonna do that"
Judge responds, "Then I'm going to issue a warrant for your arrest!"
Yes.. this is really happening
Goodwyn: “Law in Texas doesn’t require a mask”
Judge: “I don’t care.”
Judge: “if you don’t wear a mask; you will be arrested ..
Do you understand?”
Goodwyn: “I understand... that you’re saying that”
Hearing ends. When court staff arrive at Goodwyn’s home in coming days, if he’s not wearing mask, he’ll be arrested and jailed, per judge. And goodwyn indicated he won’t be wearing one. A Jan 6 defendant who is an anti-masker is facing prospect of jail pretrial
Judge orders court staff to do home inspection of Goodwyn's home in coming days.. and he orders Goodwyn to wear mask
Judge says if Goodwyn doesn't, he'll send the Marshals with arrest warrant
Goodwyn says he won't wear mask
STAY TUNED. (hearing adjourned)

ALERT - US Justice Dept prosecutor just told DC judge the feds will need til 2022 to provide all of the evidence ("discovery") needed in Jan 6 case of Timothy Hale-Cusanelli, accused Nazi-sympathizer who allegedly harassed police at Capitol
Ton of evidence & Cusanelli is jailed
"The bucket of evidence is enormous", per federal prosecutor
They warn of challenge to review and transmit evidence in usable format......
Judge hits back hard at prosecutors for arresting and seeking detention of Hale-Cusanelli considering Cusanelli is not accused of violence on Jan 6 and has no criminal history.....
Prosecutor responds violence and damage was due to "hundreds of people doing it together"
HEADS UP: Federal judge in DC has just cited "active political disputes" over the 2020 election and the protest by Members of Congress outside the DC jail yesterday (where Jan 6 defendants are being held) as a "concern" to court as it handles Jan 6 case
Judge said it was a factor in keeping some court restrictions in effect in Jan 6 case of Alex Harkrider, who's accused of being inside Capitol with tactical vest and baton
Federal prosecutors cited Donald Trump's ongoing "false claims about the election" and insinuation that "he may be reinstalled in the near future as President" as reason to keep Harkrider under restrictions
Court appearance NOW for Matthew Purse of California in Jan 6 case
Feds allege Purse falsely claimed to be a member of media while amid the mob... including with his noteworthy helmet ==>
Prosecutors ask Purse to surrender his passport and subject himself to "location monitoring"
Defense just compared this case to petty offenses (such as trespassing on federal park lands) in seeking to spare Purse from having location monitoring
Justice Dept prosecutor hit back hard... saying this was not a "petty offense"
Plea agreement hearing begins in 5 minutes in Jan 6 case of Erick Rau
Feds cite surveillance images from inside US Capitol, search warrant for GOOGLE records & alleged call between Rau and US Marshals about another Jan 6 defendant.... to argue Rau was unlawfully inside Capitol
Rau pleads guilty
Rau is pleading guilty to a *misdemeanor* .... DISORDERLY CONDUCT in Capitol Building
Maximum sentence is 6 months in jail and $5,000 fine
