Judge hits back hard at prosecutors for arresting and seeking detention of Hale-Cusanelli considering Cusanelli is not accused of violence on Jan 6 and has no criminal history.....
Prosecutor responds violence and damage was due to "hundreds of people doing it together"
Prosecutor: "This was a violent crime and defendant participated in it...."
Key issue here... Hale-Cusanelli is not charged with assault, but feds are arguing it was "violent" to be part of the mob
