THREAD: Status hearing on Proud Boys defendants Dominic Pezzola, William Pepe and Matthew Greene taking place right now. Pezzola used a stolen riot shield to bust out a window in the initial breach of the Capitol. Pepe shoved aside a barrier to allow rioters to reach Capitol. /1

The three defendants, who are being tried together, are all from New York State. Pezzola is from Rochester, Greene from Syracuse, & Pepe from the New York City area. /2

Most of the discussion right now is about discovery, which is understandably "voluminous." /3

Greene's alleged post-insurrection conduct is troubling: A witness told FBI he was part of a group that said they would have killed Nancy Pelosi if given the chance. Greene has a pending motion to revoke bond, which Judge Timothy Kelly will consider at the end of this hearing. /4

Pezzola and Pepe are dismissed. The next status hearing will be heard in 60 days at the end of September. /5

Greene's lawyer now arguing motion to revoke bond. He says, "Mr. Greene categorically denies ever threatening the lives of Ms. Pelosi and Mr. Pence." /6

Greene's lawyer characterizes the witness who spoke to the FBI as "unreliable." For context, he explains Greene came in contact w/ witness among 15-20 ppl in a hotel room after the riot bc hotels were shutting down & there was a curfew. /7

Govt lawyer cites ruling on Hale-Cusanelli in which judge kept defendant in detention on basis of talk about impending civil war. Cites other post-J6 conduct by Greene, incl. encouraging acquaintance "to study guerilla warfare tactics based on their time in Afghanistan." /8

Judge Timothy Kelly suggests the facts are even more damning for Greene than Hale-Cusanelli bc unlike Greene, Hale-Cusanelli wasn't part of a group that pre-planned actions. Notes that Greene was wearing an earpiece on Jan. 6. /9

Judge Timothy Kelly says he will deny Proud Boy Matthew Greene's motion to revoke bond. He's going to stay in jail pending trial. /10

Judge Kelly outlining his reasons for keeping Greene in detention. He says even if he accepted Greene's statement that he did not threaten Pelosi's life, he would come to the same decision considering the "mosaic of other evidence." /11

.@FoxNews and @NRCC take note: Proud Boy Matthew Greene said, "I see way too many people trying to say antifa was responsible for the capital, its bullshit too. They weren't there, can't take a damn win and admit it people are pissed off." /12

Judge Timothy Kelly notes that one of the offenses committed by Proud Boy Matthew Greene has been characterized by Congress "as a federal crime of terrorism" in that it was "calculated to affect the conduct of government by intimidation or coercion." /13

Judge Timothy Kelly notes that after Jan. 6, Proud Boy Matthew Greene placed an order for 1,000 rounds of AR-15 ammunition. That's similar to fellow Jan. 6 defendant Thomas Robertson, a Virginia police officer. /14

Judge Kelly says his primary reasons for holding Matthew Greene in detention are evidence of prior planning, incl. wearing an earpiece to communicate w/ other Proud Boys, proximity to co-defendant Pezzola, & actions after J6, incl. possessing unregistered AR-15 & handguns. /15

One interesting footnote: Defense lawyer says "Witness 1," who told FBI that Proud Boy Matthew Greene was part of a group that talked about their intent to kill Nancy Pelosi, is someone his client "knows very well," adding this person traveled to and from DC. w/ Greene. /16
