NEW: Alan Byerly has stipulated to pretrial detention. He’s not fighting it.
Judge tells Alan Byerly he can challenge his detention down the line. He’ll likely be transported to D.C. soon. #greybeaniemeanie
Government plans to engage in plea negotiations before the indictment comes down.

(Standard reminder that a plea agreement doesn’t necessarily mean a lax punishment. Most cases are settled with a plea agreement, it’s the details that matter.)
Because there’s no real detention hearing, the government exhibits weren’t shown in court. So the defense objects to releasing the videos to the public. Government arguing that the public has a right to view evidence. Judge taking under advisement.

“I thought the ‘I’ in FBI stood for ‘investigation.’ It’s pretty lame that a private lawyer for a dead police officer’s widow has to be the one conducting the investigation.” huffpost.com/entry/jeff-smi…

Great scoop from @DevlinBarrett here on the feds’ 2018 interview with Rudy Giuliani at Trump’s hotel:

A judge today denied the government’s request to revoke the pretrial release of Jan. 6 defendant Russell Taylor, finding they did not meet the “heavy” burden required to keep someone locked up before trial.
U.S. District Judge Royce Lamberth said the allegations against Taylor were “serious” and the evidence against him “substantial.” But said the precautions taken — including GPS monitoring — mitigate the government’s concerns.
Judge called Taylor’s conduct "cause for concern” and says it "warrants stringent conditions of pretrial release” but denied motion to lock him up due to the "government’s inability to identify a future threat by clear and convincing evidence.” LINK: storage.courtlistener.com/recap/gov.usco…
