@RiverWardRiley says that defining 'affordable' is not simple, but that anything near market rent cannot be called affordable. Timbercreek/Hazelview says that the affordability numbers in the MOU are a legal limit.
Timbercreek/Hazelview says the newly built units will carry over the same rent as current units (a new two bedroom would still be at the same rent as a current two-bedroom when the current one is demolished)
Timbercreek/Hazelview says that it is difficult to negotiate detailed commitments in a high-level legal document like the MOU. That's why some recreational, affordable commercial, and other pieces are not included.
@RiverWardRiley asks about three types of tenants. Hazelview's responses:
1. Current Herongate tenant who is not earmarked for demolition: Nothing will change, rent will continue to increase based on the RTA
2. Resident living in a unit earmarked for demolition is given an option to move into an equivalent renovated unit in an old building, or into a newly built unit at the same rent at they have at that time.

Hazelview/Timbercreek saying that more affordable units, or long term affordability, will just make the rest of the units even more unaffordable for regular Ottawans.
@cmckenney asks what happens after the 10-15 year affordability 'clock' runs out.
Timbercreek/Hazelview says the logistical details are not worked out, but says that it is "likely" the unit will not immediately jump in rent and become unaffordable.
What happens at the end of these 10-15 year affordability periods is "not written into the MOU" says Timbercreek/Hazelview.

Timbercreek/Hazelview see themselves as "long-term investors" in rental housing (so that they can make huge profits off of renters). They say they didn't have a "crystal ball" when they purchased the property, instead of answering whether they intended to demolish.
@ShawnMenard1: When you purchased the property, were you aware that 70% of the people living there were visible minorities?

Timbercreek: We look at demographics.

@ShawnMenard1: So you would have been aware when you demolished that 60% of kids there were in poverty
Timbercreek: We want to put more housing in that neighbourhood

@ShawnMenard1: So it was not about making money off of these people?

Timbercreek: We don't make it a secret we make money

@ShawnMenard1 How much did you make last year

@glengower doesn't think the massive profits Timbercreek/Hazelview made last year are relevant to the gentrification, evictions of radicalized and low-income tenants, or this new application.

The profits of massive private companies, which will structure the Herongate community if this MOU is passed, are absolutely relevant to any decision.
@ShawnMenard1 Why is the MOU so weak? Why do affordable units end after 10-15 years? Why are there no specifics about what happens when they end? Why are the affordability measures still so expensive for most people?

Now talking about non-binding commitments to commercial space. They might put in some convenient retail. Maybe some live-work. No firm commitment to affordability so that residents can run their own small businesses. Everything non-binding.
There will be non-binding community spaces! There is a park which is in the MOU, but all of the other nice ideas, pools and pet spaces etc are non-binding.
Hazelview threatening not to build the project if affordable houses last longer than 10-15 years. They are committed to their profits above anything else.
@ShawnMenard1 reminds the committee that affordable housing continues to exist on the site before it is redeveloped. People are renting for $1300-1500/month, which is even more affordable than the 'affordable' housing they say they are going to build on the site.
@ShawnMenard1 What we have done on this MOU is very weak. Once the official plan is passed with work on rental replacement, with new tenant protections, we will have a better overall framework than the MOU gives us.
Hazelview admits that the important details about affordable housing are not figured out. They keep using words like 'likely' and just expect us to trust them.
@ShawnMenard1 asks what Hazelview what they will do if committee does not approve the MOU today. They say they will not appeal it.

This gives space for new negotiations, with tenants involved and having a decision-making role.

Staff say yes, in the long term. But in the short-term it is of concern but there is a need for more policies to prevent this.
Staff says that the MOU gives them a good basis, from which Ottawa could buy down the rent with subsidies and grants in lieu of development charges.
@cmckenney says that when we subsidize average market rent at for-profit developments, there is a profit margin built into that which we are paying for. With non-market and social housing, we get better value for money.
City staff answer @cmckenney that when we negotiate with non-profits, we get affordability in perpetuity. When we subsidize for-profit housing, we are handing further profits to private companies. But currently, for-profit developers build more units than non-profits/public
@cmckenney says we don't even have the money now to subsidize the non-profits enough. Asks why we would think of subsidizing profits with our limited funds?

Staff says that in this agreement, we get 225 units that are actually pretty affordable, would cost city $20m without MOU

@JLeiper wants to know how many 3- and 4-bedroom units will be built at 'affordable' levels. There is no hard number

It is good that those who will get replacement units will ensure the construction of 3- and 4-br units, but anyone who does not live in Herongate may get nothing
@tm_kavanagh is asking why we don't use neighbourhood level market rents to ensure that rents aren't driven up to the city average when they sit below it.

The benefits of the average city rent is that it includes low rents which can help even out newer builds with high rents

@tm_kavanagh believes that there are measures that we could use to keep rents affordable.
City staff in the weeds of housing prices for not-for-profit providers. There is additional funding from the city to make deep affordability happen, but none of it goes to anyone's profits.
Subsidizing Hazelview will end up padding their bottom line and shareholders pockets.
@cmckenney cites provincial law, which allows buildings constructed after 2018 to be subject to rent increases beyond the RTA limits. While @cmckenney is reading it off of the province's website, city staff say they aren't sure about that rule.
@cmckenney says we need specific provisions for rent control guidelines in the MOU in order to ensure that Hazelview doesn't increase rents dramatically after the 10-15 year timeline ends, because those increases are probably what Hazelview is counting on.
@ShawnMenard1 asks why we wouldn't apply the policies that we are developing, on inclusionary zoning and affordable housing, to the MOU. Those policies would be even more robust than the voluntary MOU.
City staff say delaying while waiting for the policies that we need would delay construction of rental stock.

So it seems we are rushing into a deal just because we will get units, not because they will be the best units under the best possible situation.
@ShawnMenard1: This development will go over 25 years, how do we ensure that the strongest possible policies are applied?

Staff: We can't consider future policies, and we need to build build build
@ShawnMenard1: If we refuse this application, we can wait until new policies are in place before going forward with the buildout. What Hazelview/Timbercreek has done is a travesty, mass evictions of low-income racialized residents, and we have to fight hard for them
@JLeiper says that the residents are being left to the RTA, to rent increases, to Hazelview.

The only leverage that the city has to get a better deal is to vote against this Official Plan Amendment.
There is a process in criminal law where juries acquit someone who has clearly broken the law, in a case when the law is unjust.

That process is informing why @JLeiper is voting against this Official Plan Amendment and MOU.
@glengower says that the definition of affordability being used is still unaffordable for many of Ottawa's lower-income residents.

At Horizon, we believe we must use definitions that protect tenants, protect residents, and keep housing in public hands.
Planning Committee votes yes on the report. Votes yes on the MOU. @ShawnMenard1, @JLeiper, and @catherinekitts vote against it.

But it passes despite community opposition, tenant opposition, advocate opposition. The report recommendations now go to council.
