So, does this vaxx fascism win Biden anything politically?

I think it’s yet another bonehead maneuver by the most politically tone-deaf administration since Hoover. 1/
Everybody who is turgid over vaccines has already got them. The vast majority of people who haven’t got vaxxed have a reason, and they’re going to resent being told they have to get one or starve. 2/
Biden will get the support of some portion of people who took the vaccine, mostly lib women, but he had that already. Who is this going to win over to him? What’s the name of the person who says “Yeah, I thought he was a dork before, but now I’m all in?” 3/
He gets effectively zero support from the non-vaxxed. But many people like me who took the vaccine think this is garbage and we’re going to jam it up Biden’s Schumerhole. They’ve manage to not just anger people, but activate resistance. 4/
That includes people who used to support Biden. He’s going to alienate a lot of them. In other words, this is not going to make him any new friends. He can only lose support. And that’s especially true among minorities. Tuskegee Joe! 5/
Politically, it’s going to unify GOP resistance and increase opposition by eliminating the ability to be moderate or to stay neutral. Even the squishes have to come over. People who were neutral are not going to rush to Biden’s side. 6/
So, our genius elite has managed to attempt to impose terrible policies that will not change the epidemic one bit, and at the same time made sure that they will lose political support. But remember, they’re smarter than all of us. 7/
Oh, and don’t count on the Supreme Court to bail Biden out by negating this power grab. John Roberts, who is a genius – just ask him – will certainly ensure that it gets upheld. So look for a long fight as governors refuse to comply, people suffer & Biden stays stubborn. 8/
The cherry on top of creating a unified, energized opposition that will take vengeance in 2022 is that this isn’t going to do anything to slow down the pandemic. And watch his polls drop even lower. 9/

And 2) declare the officer personally spoke (by phone) to the individual to resolve the issue before censoring.

Enforce it with lawsuits - per se damages, civil penalties, punitive, attorneys fees. Fed jurisdiction, of course. Yet states could try it too. @Eric_Schmitt

Fun, true story...

We were in Japan for Yama Sakura in Kumamoto in 2002, I think, and after ENDEX we all hopped a bus to visit Nagasaki... 1/
The city was rebuilt, of course. Nothing glowed. We walked Ground Zero - the blast radius was smaller than you probably expect - and ended up at the Nagasaki A-Bomb Museum... 2/
Inside there were a lot of exhibits but not much context. You might get the impression that the peaceful Japanese were straight up chillin' when, for some unknown reason, the USA popped a hot rock on them... 3/

Hey, thanks Kavanaugh and Roberts for showing us why the Federalist Society/institutionalist model is totally bankrupt. Those 2 knew what the Constitution required and refused to do it to "protect the institution." Great job, guys. 1/
See, we were told that we cons should avoid judicial activists and nominate people who would faithfully apply the Constitution as written. But when it got hard, the Federalists Bros didn't do that. They folded to avoid conflict. We were told to suck it up. 2/
"We must preserve the integrity of the institution," they huffed and puffed, oblivious to the fact that by "protecting the institution" at the cost of not doing what we all know the Constitution requires, they taught us the Constitution doesn't matter. 3/

Here is Tom’s play so you nonlawyers understand it. He attempts to establish a basic principle, that vaccines in some circumstance can be made mandatory. But he doesn’t go through with the next part of the analysis, which are the facts specific to this particular situation. 1/
In fact, in the very rare instances when rights are implicated, the key is the analysis of the specific cracks. In this situation, we have a not very deadly virus, vaccines that aren’t perfect and variety of other factors. 2/
Typically, courts being asked to implicate a fundamental right, like not to have something injected into your body against your will, require the state to prove that its plan is the least restrictive alternative. 3/
