NEW: Defense attorney is arguing for release of Jan 6 defendant Edward Lang from pretrial detention

Lang has pleaded NOT GUILTY, accused of repeatedly kicking police, using bat against police, "taking glee and pride" in violence
His lawyer argues Lang can't fully participate in his own defense due to restrictions in DC jail. "Each time discovery is disclosed to us, there'll be a delay in getting it to him"
Defense argues Lang was "trying to stop the chaos" .... "This is about him jumping into a chaotic situation and doing what he can...."
Judge questions defense about allegation that Lang is swinging a baseball bat at police officers... and allegation that Lang is holding a police riot shield.
Judge: "Do you contest there is evidence that there's video showing Mr. Lang swinging a riot shield?"

Defense: "I don't contest that"

Judge: "Do you contest there's ... evidence of Mr. Lang kicking an officer on the ground?

Defense: "We're still looking into that"
Defense: "There was no intention to actually harm"

Defense is arguing that it would've been more dangerous if others were swinging the bat, rather than Mr. Lang. Defense says Mr. Lang picked up a police officer from the ground and that others in crowd were not happy about it
Defense: "In the jail, Mr. Lang isn't treated the same..... was sent to the hole for two months.. basically for people not liking him"

Defense: "He still hasn't gotten a haircut or a shave"
Prosecutors:

Lang said, "If you're not going to fight .. move"

"He repeatedly... joins the group of rioters in small tunnel pushing... with all their might against officers guarding the door"
Feds: Lang was kicking and punching police officer....
Lang is speaking now in court

Mentions his past as a scholastic athlete, member of the gifted-and-talented program in school
Lang says he was thrown "in the hole" for asking questions during his time as inmate
Lang says jail moved inmates on Sept 18 during the Capitol rally

Lang says his kosher food rations have been reduced

Lang says they sing the national anthem regularly in the jail... "the government is hiding police brutality"

Let's see how judge is gonna react to this
Lang says he witnessed "disgusting police brutality" on Jan 6. "i was there to film"

Judge admonishes defense attorney for allowing Lang to engage in this line of argument
And.. Lang says he has religious objections to taking the COVID-19 vaccine
Lang is now the latest defendant to complain before a federal judge about nail clippers in the DC jail

The latest.. not the first
Defense: If Lang were granted bond, Lang would live with his father (parents are in courtroom for this hearing)

"(He) poses no risk to the community"
Defense is now complaining about the required quarantining for meeting with client

Judge responds.. but (your client) won't get vaccinated. "You can't possibly be asking me to (revise) the jail's policy?
Judge says “Evidence suggests [Lang] was under the belief the government of the United States was illegitimate”…. “And said very concerning things about the Inauguration”

Judge will not release Lang from pretrial detention

STANDBY: Donald Craighead is scheduled to appear in court this hour. Craighead, of California, is accused of having a machete in his pickup truck near Democratic National Committee headquarters yesterday. And police say the truck had a swastika image on it
Per court filings from prosecutors, Craighead told Capitol Police, "Why are you pulling me over when there are brown people hurting white people" ==>

Mock's accused of multiple assaults vs police (One of which led to "excruciating pain" for officer), alleged threats vs ex-girlfriend, prior case of putting gun to kids' heads

Feds tell the court they have made a plea offer (verbally) to Mock. More formal offer forthcoming, per prosecutor

Right now: Defense for Ethan Nordean is again for arguing for his release from jail in Jan 6 case, saying family will put up $1 million bond. Defense has accused Feds of falsely suggesting bond $$ might be “dirty money” (lawyer argued same to me in series of emails)
Feds are arguing Nordean was conspirator. And they tell judge “minutes after he arrived at Capitol, he stormed the gates”
