Sam Alito, man.
Alito complains that the most silly criticism of the shadow docket is that they're late-night rulings. He mentioned that #SB8 was going into effect at midnight as a reason why SCOTUS has late-night decisions, but didn't mention that SCOTUS didn't rule before it went into effect.
Alito says that full briefing would have been impossible in shadow docket cases like #SB8 — ignoring the possibility that Chief Justice Roberts himself offered up: a temporary stay preventing #SB8 from going into effect until full briefing could be held.
Sam Alito: We do a pretty good job of explaining shadow docket decisions.

Sam Alito, 2 minutes later: Most shadow docket decisions contain so little information, what good would it do to put a justice's name on the order?
Asked about pandemic-related changes, Alito talked about advantages and disadvantages for the justices of not working at the Court/working from home, but doesn't mention the livestreaming of arguments or how arguments were held.

So, before I got Covid, I was supposed to be running a half-marathon yesterday. Needless to say, losing basically all of September from running meant that was a no-go. But, today, I did finish a 10K, with a (very uneven, but, so it goes) 8:30 pace. So grateful to be back at it.
It’s World Mental Health Day, and I’ve talked about this before: For me, running has been one of the most successful tools I have to live a happy life with my bipolar—along with medication and therapy. Getting a run in like I did today, and I just *know* I’m re-centering myself.
Over time, I learned that other types of exercise worked basically just as well for me, but it was the running that really started me on a path to finding happiness living with my diagnosis. Of course, for me, quitting drinking (years after I’d been running) helped a ton, too.

Still obsessed w the BJay Pak stuff in Georgia. It seems like the additional info from the report (tho I might have missed reporting on this) is that Donoghue just decided while talking w Trump on 1/3 that Pak would be "resigning" the next day — to stop Trump from firing Pak. Image

Is this an alternative universe thing? I mean, why is Tucker in, like, a lodge or something? What is this? It can’t be about our universe.
This makes me so mad. Like, we had an entire generation of gay men stigmatized by most of the nation in what was already their most traumatized moment. People who weren’t gay and contracted HIV were often just as stigmatized. There were and are HIV-specific criminal laws!
“Failure to make moral judgments on this behavior is why we have this epidemic. To my knowledge, the President has never said that we are to abandon moral judgment on these types of matters.” - Reagan staffer Carl Anderson, in a 1987 White House memo

So so so very good to be back. 🎭 I’m here tonight because I realized that if I didn’t make it to a theater before Tuesday, I’d not have seen any in-person theater while I was 43. To get to have the one show be a James Baldwin show feels more than right. 💖 To the theater. ImageImage
🥺 I missed you so, live theater. 😍
It had been 580 days since I last attended an in-person theater performance. I teared up when I picked up my ticket from will call. I sat quietly, filled with such gratitude, as the actors made their opening entrances. We all stood, applauding, as the show came to a close. 🎭
