Court is starting for day 20 of the ‘Sines v. Kessler’ civil trial in the Charlottesville ‘Unite The Right’ lawsuit.
Judge Moon is excusing a juror whose two children were possibly exposed to COVID-19 at their school. The juror is unvaccinated.
Judge Moon calls the jury in, before he begins reading them their final jury instructions he tells them about excusing juror 210 due to the COVID issue.
Judge Moon reminds jurors that they have to consider all witnesses’ testimony regardless of who called them. Reminds them that opening and closing arguments are not evidence.
Judge Moon is delivering lengthy jury instructions now, telling jurors they must choose a foreperson, should make their own decisions about the facts etc.
Moon is telling jurors about how to fill out the verdict form when it comes to their findings as to conspiracy liability and compensatory and punitive damages for each defendant.
After more jury instructions, Judge Moon sends the jury to the jury room to begin their deliberations.
Moon says he got a note from Juror 164 asking about the court finding that Robert Ray & Elliott Kline were found to have conspired to engage in racially motivated violence and asking if all they have to decide about those 2 is damages - Moon says that’s for jurors to decide.
Judge Moon is reading a note from a juror - something with a question about “finding all 5 elements” against a defendant
The audio feed got turned back off…all we know for sure is it seems the ‘Sines v. Kessler’ jury is still deliberating.
Seems like the 'Sines v. Kessler' jury is on their way back into the courtroom
Judge Moon is back at the bench, court is in session, likely just to release jurors for the weekend but we aren't sure yet.
The jury is filing back in to court now, Judge Moon says "I understand you would like to retire for the day."
Judge Moon says some jurors asked to take jury instructions home for the weekend, which he says is allowed but he doesn't recommend it, and they can't discuss the instructions or show them to anyone.
Jurors will resume their deliberations re: the verdict in Sines v. Kessler on Monday morning at 9 AM. Judge Moon just officially excused the jury for the weekend and has now left the bench, the attorneys are leaving the courtroom now.
