Justice DY Chandrachud: This is in pursuance to NEET PG.. and for 2021-22. pleas were instituted in Aug 2021. notice was issued on september 2021 and results were announced on sept 28. it was argued that there cannot be reservation for OBC and EWS
Justice DY Chandrachud: By an order dated 21 Oct 2021, this court had sought clarification for the 8 lakh limit for EWS. When the hearing was taken up then affidavit was not filed and it was assured that it will be filed and we had framed issues
Justice DY Chandrachud: Centre on Oct 25 deferred the counselling and then justified the 8 lakh limit on Oct 26. On oct 28 SG sought an adjourment and sought time till after Diwali. then SG said UOI will revisit the EWS criteria
Justice DY Chandrachud: centre formed a committee on nov 30. the committee stated the criteria be retained for the current academic year. centre then submitted that obc and ews with old criteria be allowed for 2021 admission
Justice DY Chandrachud: submission necessitate a detailed interim order on the detailed EWS criteria for NEET PG 2021. Formulation of reasons for the order will take sometime. criteria for NEET PG EWS AND OBC QUOTA IS UPHELD
Justice DY Chandrachud: we accept the cpandey committee report. counselling for NEET PG AND UG will be taken place in consonance with the notification as given effect to in office memorandum
Justice DY Chandrachud: criteria mentioned to identify EWS will be used for NEET PG AND UG. The Pandey committee report will be subject to the final validity of the subject assailed.
Justice DY Chandrachud: we have upheld the constitutional validity of 27 percent reservation for obc in NEET PG AND UG. For EWS this year the 10 percent will apply for this year and the prospective ruling will be decided on a final EWS hearing to be held on March 3, 2022

Datar: They formed a committee in 2006 that gave a report in 2010. I'll call it the Pandey report as Ajay Bhushan Pandey led it.
The Sino committee came to the conclusion after extensive study..
Datar: The commission consulted state govt and UTs, NGOs and social leaders. It contains exhaustive discussion of each and every party. For eg Tamil Nadu said we have 69% reservation we don't need economic one at all.
