The unlawful Scottish guidance says people may self-identify when answering the sex question in the 2022 Scottish Census. The ONS was forced by the English court to remove similar guidance for the England and Wales Census in 2021 /2
What is meant by “sex” in the 1920 Census Act is a matter of statutory interpretation, and as such a question of law. There is no provision currently recognised in law that permits any form of self-identification to affect one’s legally registered sex. /3
The Scottish Guidance authorises and approves conduct which could amount to an offence under the 1920 Act. The Guidance is therefore unlawful and should be amended. /4
The ONS wasted over a hundred thousand of pounds of tax payers money in a desperate attempt to defend their unlawful position in court. It's beyond belief that the Scottish Gov is repeating this reckless act and forcing ordinary members of the public to go to court once again. /5
Extreme gender ideology is deeply embedded within the @scotgov and promoted at the highest levels including the First Minister. Winning this action will constrain Ministers’ pursuit of their ideologically-driven agenda with no regard for Scottish women or long-standing UK laws /6
@scotgov What is meant by “sex” is a question of law – not a matter on which Scottish Ministers can simply take a view. If Nicola Sturgeon wanted to change the definition of sex in the Scottish Census she should have convinced her own parliament. Her Ministers tried but failed to do so /7
@scotgov .@NicolaSturgeon does not have the power to make up her own definition of "Sex" and force it through regardless. That’s not how democracy works. We are bringing this legal action to defend the rights of women and girls in Scotland /8
@scotgov@NicolaSturgeon Sex and gender identity are different characteristics and should not be conflated in data collection. Everyone has a sex in law, including transgender people and both piece of information should be captured by the Census /9

In September 2021 the UK Sports Councils launched revised guidance on transgender inclusion in sport clearly stating that testosterone suppression doesn’t make it fair for males to play and compete with females. The route to full inclusion is Open and Female /2
But only a few weeks later, the IOC headed in the opposite direction suggesting there should be no presumption of performance advantage between the sexes and told sports to make their own rules /3

Fair Play For Women sought permission to intervene to represent the interests of women and girls. Permission was not granted but our submission made it clear this was not simply an admin matter. The outcome impacts others. /3
Last week Fair Play For Women threatened a judicial review if the deadline for public responses was not extended.
Today, the Government has conceded and will announce the deadline is to be extended by a further 8 weeks, more than doubling the consultation period to 14 weeks /2.
Two autistic women joined Fair Play For Women as co-claimants threatening legal action accusing the Government of breaking disability discrimination laws. /3
Legal action is an important tool in protecting the sex-based rights of women & girls. Supporters tell us they do, too. The right legal outcome can set a precedent, or stop one, and show public bodies they will be held to account. /1
