[Patna Shelter Home Case] #Patna High Court has taken suo moto cognizance. A reply has also been sought from Bihar’s social welfare department.

An inmate of a shelter home had alleged that she and others were forced to submit themselves to “immoral acts” after being sedated. Image
The High Court has stepped in on the recommendation of its Juvenile Justice Monitoring Committee (JJMC) which had disputed the clean chit earlier given by the Social Welfare Department to the #shelter home.
In its report, JJMC had stated,
"Director of Social Welfare Department has conducted an inquiry and only on the basis of the CCTV footage installed in the After Care Home has come to the conclusion that the accusation made by the so-called victim is baseless and false."
"It does not appear that any inquiry was made with the victim girl and such opinion has been arrived at only by seeing the footage of CCTV camera," JJMC had further noted.
However, for now, the High Court has refrained from issuing any directions and has asked the Bihar Government to examine the matter and file the action taken report on the next date of hearing.
Importantly, in its report, JJMC had also disputed the clean chit earlier given by the social welfare department to the shelter home.

“On account of such dilatory tactics adopted by the accused, evidences disappear eventually leading to their acquittal. At that time, there will be a hue and cry saying that the system, without any material thereof, had kept the person in prolonged incarceration," court added.

*need not
J: Mr. Mehta, let me clarify, this bench had no role in having the matter listed.

SG: Central government didn't get time. Your Lordship need not clarify anything on that.
J Shakdher: The central government has to take a decision. This is a matter where we want to hear you.

It doesn't gel with us if we keep the matter pending.

You're under instruction, I understand. It's not easy doing a solicitor's job.
