Supreme Court to hear plea by ex Mumbai top cop Param Bir Singh seeking protection from coercive steps by Mumbai police in the cases registered against him #SupremeCourt
Supreme Court: What happened to him?
Counsel: this is a deliberate attempt to get the SLP not listed. look at the audacity of the state to approach HC to quash a FIR registered by the CBI. This was on orders of SC. I dont know if HC supersedes the top court
Justice SK Kaul: We have seen a longer time so we have seen more (on the lighter side)
Counsel: this is going out of hand
Justice Kaul: We said we will await their ability to get an order from this court
Sr Adv Darius Khambata: We have got the SLP numbered and it will be listed
SC: As the position now there is no impediment to hand it over to the CBI. But in perspective of larger contour we allowed the HC to see but this conduct is not proper
SC: If you both have no problems then we can treat HC order as final and proceed further.
SC: In view of circumstances but one matter has gone to CBI then we have to see if this matter should also go to CBI. But the state now says it cannot. we have no difficulty in hearing this
Counsel for Singh: they have gone to the HC saying that there was bias.
Sr Adv Darius Khambata: this is an attempt to unnecessarily prejudice us my lords
SC: I take the state assurance that there is no challan registered
Khambata: we have already filed an affidavit in this regard
SC: I take the state assurance that there is no challan registered
Khambata: we have already filed an affidavit in this regard
Khambata: CBI filed 5 FIRs
Justice Kaul: We have had occasion to say earlier that it is messy state of affairs. this is an unfortunate situation. it has the propensity of unnessarily shaking confidence of people in police system. Process of law must be carried in a manner
SG Tushar Mehta for CBI: It is in the interest of things that all cases herein be investigated by the CBI. Once you proceed with an investigation and record it then its not fair to stop midway state should not do anything that makes the process difficult
SC: we will take a call one way or another. We will take this up next Tuesday, we have final hearing matters this week and not many people are coming for the same. so we have time in hand. We will list this on March 2, 2022
SC: We will take a call if investigation have to be Transferred to CBI. Meanwhile state to stay its hands.
ORDER: We had earlier deferred this case and it was expected of state to list all the matters before us. that has not happened. it is said SLP is of limited nature
ORDER: Matter is such we have to take a final call one way or other. parties to file synopsis not running more than 3 pages. list on march 9, 2022 for final disposal
ORDER: The synopsis to be filed within a week. cousels who would like to be connected online on March 9 for hearing can give their names before. They will be taken in #supremecourt
ORDER: Documents have been brought in to show that orders of this court has been violated in spirit since challans have been filed. However state says its not so as chalans have been filed against other accused but not against #parambirsingh
ORDER: We have now put down the matter for final hearing, investigation being completed can pose problems. Mr Khambata has assured that put their hands on hold. we take the assurance on record #parambirsingh
ORDER: We don't believe that in nature of proceedings intervention is called for but the counsels can assist us during the final hearing..
