#SunshineWeek 🧵on e-carceration, profiteering, and how long ICE has known about allegations and criminal convictions of its largest (and often, only) gps ankle shackle contractor, courtesy of DHS-OIG #FOIA
1/
Since Congress started funding “Alternatives to Detention” for migrants in the US, in the mid-2000s, ICE has received allegations of serious criminal misconduct by this contractor’s personnel. documentcloud.org/documents/2141… / 2
Allegations like this one in Miami dating back to 2007. 3/ Screenshot of April 13, 2010 Memo from DHS-OIG to ICE-OPR reScreenshot Cover page of DHS-OIG Report of Investigation on
Another BI Miami office case, with allegations and investigation starting in 2011 and culminating in conviction seven years later. 4/
So, when @RAICESTEXAS notes the high reported rates of actual harm from digital incarceration, that is literally the tip of the iceberg. 5/
Here’s another sexual assault allegation OIG investigated involving a BI contractor who resigned from his ISAP position in Marlton, NJ before the allegation was made. 6/
Fmr BI guy told the IG during a voluntary interview that he’d always behaved professionally.

His office mate told IG she was shocked

BI told the IG he’d been counseling for sexually harassing comments twice, and wasn’t written up the 2nd time bc he said he was leaving. 7/
Humble request to Miami #ImmigrationTwitter bar for anyone who can help track down this migrant’s counsel. He and his clients were apparently unable to offer enough evidence to convince the IG something was very wrong with BI in Miami.

This is a detailed, credible account.
7/
Roughly 10 years before a court sentenced Miami BI contractors based on the IG’s undercover investigation in 2018, the migrant’s attorney in prior tweet gave them the whole thing in a nutshell. 8/
(Obligatory #FOIA LOL at the poor contractor who thought federal district judges’ names or charged and sentenced criminal BI contractors’ names are subject to that b6b7C redaction. You’re getting nominated for next year’s @MuckRock #FOIAFollies)
9/ q
What is the cost of lengthy, delayed response by oversight bodies?

Who benefits from their failures?

Time, for anyone in business with the world’s largest-ever carceral state, is expansion, revenue, and deeper intwining in budgets and economies. 9/
We must center and uplift the racialized nature of exploitation and profiteering at play in these records. It’s the anti-Blackness @GuerlineMJozef and @HaitianBridge teach us serves as the system’s most unchanging feature. Racially disparate ISAP= racially disproportionate effect
As we consider the present and look at what today’s decisions to electronically cage an unprecedented number of migrants for so-called “civil” reasons, we have to understand that for all of these allegations, there are demonstrably untold numbers of other people being harmed. /10
It isn’t just migrants and refugees being electronically tethered.

It isn’t just people ensnared in the legalized slavery that constitutes the US criminal punishment system who file inside digital prisons.

It’s people being prosecuted by Other Companies.
/11
So, as hard as this may seem, given your personal perception of proximity to these system, you must understand that what you’re reading about in this investigative records could and is happening to “people like me”.

And it’s growing. You can help stop it.

In honor of #SunshineWeek, the #DetentionKills Transparency Initiative
is releasing these recently obtained DHS-OIG offered these records of alleged misconduct and abuse by DHS contractors. You probably don’t have time to read all 547 pages. So we did. 🧵 documentcloud.org/documents/2141…
On page 3, OIG documents receiving a complaint in 2006 regarding the allegations in the litigation LeTisha Tapia’s family brought against $GEO.

Those allegations are shocking, but unsurprising.
@POGOwatchdog’s contractor database has more: contractormisconduct.org/misconduct/256…
2/x
OIG appears to have referred the allegations to ICE in early February 2007 and closed the file. Wonder how ICE responded 🤔
In the years that followed, at least three senior ICE officials who would have received this complaint from OIG went on to join $GEO’s board or C-Suite.

On January 25, 2020, Ben Owen died in the Baker County Jail while being imprisoned by ICE. In its mandatory report to Congress, ICE said that agents arrested Ben because he was in the U.S. without authorization. 1/4
This was a lie. Tammy filed a marriage-based green card petition on Ben's behalf before his visa expired. ICE never shared that detail with Congress. Yesterday, Ben's widow Tammy filed notice that she intends to bring suit against the United States for wrongful death. 2/4
We, the #DetentionKills Network calls on @POTUS and @AliMayorkas to bring @ICE into compliance with the law requiring the agency to provide death reports within 30 days of a tragedy. Four people have died whose deaths ICE did not provide reports on since September 2020. 3/4

Someday someone’s going to write a well-received book that compiles the public statements top lawyers in this regime made and weighs them against the statements made when subject to Rule 11 in court pleadings and tell the story of the constant delta between those statements.
Im talking about political appointees who are also lawyers, defending the policies and saying things out of court, on the one hand, versus DOJ lawyers signing pleadings and lawyer who sign declarations, on the other.
You could spend an entire chapter on the lies federal courts have caught DHS in and documented and threatened to sanction them for. Judge Hatter. Hamama. The Massachusetts covid litigation. The Mesa Verde covid litigation. Fraihat. DACA. Ms. L.

So. Many. Habeas. Cases.

“Wanted by ICE*”

(Just not badly enough to go to a neutral magistrate and get a warrant because that’s how much we care about the public safety mission we say we serve: We are literally not willing to just go get a warrant for a guy we put on a billboard.)
ICE pretends the Fourth Amendment has nothing to do with public safety. They want the people reading this billboard to be okay in a world where their agents can arrest anyone, anytime, anywhere. Don’t worry, though, just “bad” guys. (And some kids)
A #FOIA I’ve been meaning to do but have to admit to myself I won’t is to seek the Fugitive Operations Worksheet or Field Operation Worksheet for the FugOps teams who are supposed to be looking for guys like this man and then measure them against ICE’s effort to pick a scary face

So many people in movement worked so hard for candidates who weren’t even their third or fourth choice. And they won. Which means you have to listen to them. Sorry. That’s how this works.
(They also *knew* y’all were gonna do this. People who sat it out *told* them this is what the corporate party folks would do. Once they’re expendable again they’re disposable and it’s time to be quiet and let adults make deals. They knew you’d do this but worked anyway.)
The timing on it is just such a betrayal.

Couldn’t even wait until the national race was called to put people in their place.

If you want to build a left coalition around defending these broken, racist, toxic, deadly, costly institutions, prepare to answer why.

Just remember, as you watch how the police are going to treat white people showing up to the counting spaces in the next couple days, what you saw all summer.
Watch how the media describe white people’s behavior.

“A tense scene.”
“tensions running high”

Watch for emotional characterizations of their behavior that treat white people as complex humans with needs & desires.

You won’t here “vandals” “trespassers” “looters” “rioters”
They have really strong feelings about this election’s outcome and they’re expressing those feelings and things sometimes get out of hand but aw shucks democracy.

Non-white protestors are characterized by the government and media as mobs.
