The #UluruStatement sequence is key. A Voice to Parliament protected by the Constitution, then a Makarrata Commission for treaty & truth telling. This was settled by the USFH process & should not be re-litigated. Below are some points on why this is key for Voice & Treaty #auspol
Questions have been asked about the advisory only nature of the Voice, implications about its lack of power, and about it ceding Indigenous sovereignty or rights. None of this is correct (has been disproven multiple times) & misunderstands challenges faced #UluruStatement #auspol
Treaty has been the important goal for the Indigenous community for a reason. It remains part of the #UluruStatement for that same reason. But Treaty, because of our local circumstances & history, cannot deliver on the expectations that are attached to it. #auspol
The expectations are legitimate - Indigenous sovereignty, law, land, culture, our rightful place, decision making power, reparations - the pathway to having them enforced and protected however is not so simple. #UluruStatement #auspoll
We are not in a first contact scenario. We are 230 years into a developed relationship from within which we face a cemented Australian legal and political system, of which The Australian Constitution sits at the foundation. #UluruStatement #auspol
This means, despite how much we believe otherwise and can prove otherwise, our relationship & recognition with the Aus state will continue to occur within context of the Aus state & the international legal & political system that is authorised by states. #UluruStatement #auspol
Some will always refuse to accept this because the Aus state is illegitimate. The reality is that's not how legitimacy works, so we need to find a way to enforce our sovereignty & rights. Even UNDRIP occurs within the context of the nation state. #UluruStatement #auspol
This means we're not in an equal, state-to-state rshp. Indigenous ppls (acc to Aus state & intl community) do not have intl legal personality. There is no help from that community other than what exists - i.e. UNDRIP & rshps with other Indigenous ppls etc #UluruStatement #auspol
This brings us back to the Voice before Treaty & expectations around Treaty. Some have said voice is advisory only & won't have power like a veto. Treaty will not deliver that either. Nothing will. Treaty will occur within the context of the Aus state. #UluruStatement #auspol
This means we must influence & change the way the Aus state operates to achieve that result. No Aus Govt is going to enter agreement that cedes their power; the Aus Parliament & Constitution will remain paramount, over Voice & over Treaty. That is a fact. #UluruStatement #auspol
Implementing structural reform first to influence how things are done, to influence parliament, to mount Indigenous political empowerment is key. That is how we impact decision making itself. That is how we ensure meaningful treaty & truth telling next. #UluruStatement #auspol
Treaty cannot do that. If we were to pursue treaty & truth-telling without a Voice, it would remain susceptible to future governments to overturn & override, including tearing up treaties from which we would have no recourse to mobilise influence around #UluruStatement #auspol
The regional dialogues understood this. They spoke of the toll of negotiating with government & others within the current system & pointed to the minimal types of agreements & outcomes we would get from that system without change. #UluruStatement #auspol
So the takeaway is that regardless of what we do the Aus state, constitution & parliament remain paramount. Some will not accept that. It's the fact we must face. Voice enables us to influence & change that system to ensure we can achieve what we want. #UluruStatement #auspol

The cheek of anyone writing for the Oz accusing others of living in a post-truth world is incredible considering their relentless post-truth campaign against the Voice, and so much more, but here we are with this nasty, personal & defamatory attack on Sally Scales 🧵 Image
The APY art centre story built by the Oz stinks. But not for the reasons they would have you believe. Full disclosure by me, something the Oz team won't bother with around their investigation, I consider Sally a close friend/colleague. So take/leave as you will.
A couple of points need addressing. Allen has laid them out to follow. Firstly this nasty attack. Accusing Sally of lying while characterising her as "squirming, whinging, evasive, hectoring, self-pitying, dithering, repetitive, inarticulate, formulaic and resentful"... Image

Below is my personal reflection after this past week on the referendum result & having read & heard too much from too many that have not learnt a single thing. It seems punching down on Indigenous people remains a national past time & also to be good for business.
I was going to engage with some notable contributors but we all know who they are and which masthead they majoritively write for. Some notable exceptions to that rule coming from usual “progressive” suspects.
Those that hate Indigenous people have been emboldened and bolstered by mainstream society & institutions happy to use us for their personal gain. They’re now hastening to attack all elements of Indigenous existence. The true test of this country grows in magnitude.

Alright. This ridiculous $40 billion on Indigenous funding/programs myth. I’ll post a full detailed explanation on my website & link here later. But here is the run down. It’s a lie. Deliberate to mislead & sow division. #VoteYes #VoiceToParliament #auspol 🧵
The $40 bill figure comes from the champions of fear, lies & misinformation @FairAusADV. That should be concerning enough. You can read their creative accounting here: #VoteYes #VoiceToParliament #auspolfairaustralia.com.au/vote_no_to_the…
The figure is one they’ve made up by adjusting the Productivity Commission’s 2017 figure of $33.4 billion for inflation. This misrepresents what that figure actually is. They even claim the figure is bigger than our defence budget - it isn’t. #VoteYes #VoiceToParliament #auspol

The Voice is about empowering communities, not the same privileged few. Here's Warren (@nyunggai) supporting $500m in cuts to community programs in 2014 while arguing for $600m more. His finger prints are all over the failure to close the gap 🧵#auspol #VoteYes #VoiceToParliament
This was under the Indigenous Advancement Strategy. Abbott's landmark policy that brought Indigenous affairs into PM&C & gutted community support. The IAS was key reason behind many calling for change at the regional dialogues leading to Uluru #auspol #VoteYes #VoiceToParliament
Warren was chair of the PM's advisory council, later a candidate for the Coalition under another PM. Here he justifies cuts, but also refuses to answer questions about cuts to vital community programs with lasting negative impacts #auspol #VoteYes #VoiceToParliament

There will never be “veto power” for Voice, or Treaty, or any kind of arrangement for Indigenous peoples in Australia. It’s impossible. It’s important to understand why. This is not a limitation of the Voice proposal. It’s an impossibility 🧵 #VoteYes #UluruStatement #auspol
Under the Australian system of democratic governance established by our constitution, the parliament has legislative power/authority. That’s the house of reps & senate. That’s it. They’re/it’s sovereign. #VoteYes #UluruStatement #auspol
Being able to give “veto power” to another institution would be to fundamentally alter the entire system of governance established by our Constitution, it would mean tearing it up & starting all over again. #VoteYes #UluruStatement #auspol

This is quite something from David Littleproud & @The_Nationals - I’ll think you’ll find bureaucrats swanning in & out of Indigenous communities is a massive part of the problem we have now, that is the status quo that is failing our people. #UluruStatement #auspol #VoteYes 🧵
Let’s not forget again here @The_Nationals have zero credibility on what will work for closing the gap. They had the Indigenous affairs portfolio for almost 7 years out of the past decade. #UluruStatement #auspol #VoteYes
This idea the Voice is just another layer of bureaucracy is nonsense. Those pointing to the Langton & Calma model are conveniently ignoring the fact it’s an example only & Govt is committed to designing final Voice with community itself. #UluruStatement #auspol #VoteYes
