Wakenya, with few hours to go before we vote for our future, here's some more about the state capture, cronyism & investor shakedowns in the energy sector especially in wind power.

2. As we queue for unga, remember that energy prices - bus fare, fuel, kerosene & electricity bills affect our cash flow and interferes with our ability to manage our household budgets & whether you will eat your ugali with mboga or nyama. Yaani kusukuma wiki.
3. Kinangop Wind Power was a 60 MW project in central Kenya. Hundreds of local farmers were set to benefit as the wind turbines were to be erected on their farms, and wayleave transiting the area would have seen these farmers get huge amounts 💵💵💵.
4. Kinangop obtained financing 10 plus years ago & imported 60 @generalelectric 1.6MW wind turbines, which are now rotting in Ruai.The powers that be in central Kenya including politicians & brokers demanded bribes from the project investors. They declined.
6. Further North in Marsabit County, the govt is both a player & referee. The county entered into a partnership with China Water & Electricity Company for a 300MW wind project in Bubisa outside Community Land Regulations 2017 with zero community consultation.
7. In that same Bubisa, Gitson Energy has a 300MW site with community participation & revenue sharing plan. Since Gitson - ask James Gitau - refused to pay bribes & kickbacks to politicians & brokers incl. @StateHouseKenya, it was sabotaged & remains stalled.
8. In the same Marsabit, @KenGenKenya is developing a 1000MW wind farm next to LTWP, which wants to produce another 300MW & has discovered that KenGen is "convenient". These schemes ensure that corruption is priced into these projects & keep stima prices 📈.
9. The Marsabit County Govt, CS Lands, Chief Lands Registrar & NLC continue to refuse to act within the CLR 2017, which will allow communities in Marsabit to register their community land and deal with investors directly. Ultimately empowering Wanjiku 💵.
10. Politicians & brokers are busy auctioning hundreds of thousands of acres of community land in Marsabit. Like clockwork, @LTWPOfficial is in court seeking an open-ended extension period not to comply with CLR2017 & delay the benefits to local communities.
11. They continue to rake in billions 💵 while locals starve.
We have wind, sun & geo IN EXCESS but we will never enjoy lower stima prices until generation, transmission, regulation, distribution/sale cartels are stopped dead in their tracks.
So: Gulf Energy (acquired by Rubis) illegally imports 30,000MT of fuel on 30Dec '21 & quietly off loaded it until 2Jan '22. No public tendering whatsoever. Gulf "mysteriously" jumped the queue ahead of 4 vessels with legal imports.
2. The 4 vessels attracted demurrage of Ksh100M that will be passed on to us @ the pump. OMAK raised the alarm @DCI_Kenya@EACCKenya@EPRA_Ke @Petro_MiningKE & threatened legal action.
The Rubis CEO Jean-Christian Bergerone clutched his pearls & feigned outrage.
3. Bergerone roundly condemned the illegal importation [his company's import] & proposed that the loot be shared with OMAK members. Rubis breaks the law & plays victim. Maajabu.
Be advised that your Deputy Registrar, Constitutional Division (Milimani), has repeatedly declined to sign our Petition 6 Notice of Appeal that #EnergyJustice6 filed on November 5th 2020.
2. When Apollo Mboya secretly settled Petition 6 of 2018, he was awarded costs to be paid by @KenyaPower & @EPRA_Ke. This is in addition to an amount he allegedly received to kill the case focusing on the theft of OUR Sh10.1B by KPLC.
3. #EnergyJustice6 sought to revive the case in court because Apollo should not have settled it privately. This is about high bills, vendor cartels & thieves.
3. The Constitution of Kenya is inoculated from the mischief of those (eg. The Handshake Bros) who would "design" a "popular" initiative - using state resources - in the form of an amendment bill that alters fundamental underpinnings of the COK.
Diaspora member @KaranjaMatindi (UK), the 2nd interested party, this morning filed a fresh application under a Certificate of Urgency for conservatory orders to prohibit President Uhuru from directing @IEBCKenya to conduct a referendum on BBI.
2. Until the Diaspora Voting Registration case E069/2020 filed by another Diasporan James Gitau (USA) is heard and determined. It prays for prohibition of IEBC from conducting any Election until it complies with the SCOK orders of 2015 & COA orders of 2014.
3. The SCOK & COK ordered the registration of the Diaspora as voters and file annual reports to National Assembly & the Senate. The passage of the BBI Constitution Amendment Bill (2020) by both Houses of Parliament Mbunge will render the instant suit moot.
