SC: it is important to highlight on power of deputy speaker to initiate disqualification proceeding when such proceeding has been initiated against him. Here Nabam Rabia judgment needs gap filling.

SC: Thus a constitutional bench to look at the gap filling and a bench of 5 judges to look into this along with the issue of notice of removal of speaker.

CJI: what is impact of removal of para 3 of 10th schedule, what is the scope of interplay with 10th schedule, what is the scope of powers of speaker, what is the scope of power of ECI when there is rift in party. All these questions to be decided by the larger bench

Sr Adv Kapil Sibal: Eknath Shinde's disqualification plea is pending and if he is disqualified how will he continue. EC is dealing with symbol plea from a faction who is facing a deemed disqualification

CJI: But it has to be decided by the election commission

CJI: List the matter before the constitution bench day after tomorrow and the bench will decide about the symbol related EC proceeding at the beginning. #MaharashtraPolitcalCrisis

Sr Adv Sibal: EC has to stay it's hands for a week atleast.

CJI: till the constitution bench hears the matter, let the election commission not do anything till then
