Special CBI Court, Rouse Avenue to hear bail application filed by AAP minister Satyendra Jain in a #MoneyLaundering case.

Special Judge CBI asks ASG SV Raju to clarify on several issues including what is the evidence to show that the money belong to Satyendra Jain, what is to show that Jain was a beneficiary, etc.

ASG Raju submits that our case is not that he is a share holders and that is why he is the beneficiary. We are arguing on De-facto Control. There are many cases wherein drivers, etc. have been made share holders.

ASG Raju: The disclosure is of about Rs. 16 Crores and there are findings of Benami transaction.

ASG Raju referring to a convenience compilation submitted that Satyendra Jain was in De-facto Control of these companies and these two people were just dummies. Prosecution may prove its case on direct evidences and circumstantial evidences.

ASG Raju: On 27 June 2018 Satyendra Jain wrote a letter to the Asst. Commissioner Income Tax, he was required to deposit 20% of the demanded tax. It was said, it can be adjusted from companies of Vaibhav Jain and Ankush Jain. It was all his money.

ASG Raju: Who would allow it unless he is a Satyendra Jain's dummy? They are two sides of the same coin.

ASG Raju further submitted that another argument that was made is that he was threatened to be arrested, he was not threatened to be beaten and all and I'm my opinion, threat to be arrested does not amount to coercion or a threat.

ASG Raju referring to Satyendra Jain's wife, his wife used to sign documents on instructions of Vaibhav Jain, that means Vaibhav was a person of great trust.

After Satyendra Jain seized to be the Director, a meeting was held after he became the Minister wherein it was decided that the money would be paid by Satyendra Jain.

Court: Who is cheated?
ASG Raju: The company was cheated.
Court: The company belongs to him only...
ASG Raju: Your Honour, a company is a separate legal entity.

ASG Raju: As per my investigation the entire thing was done by Mr Satyendra Jain.

Court: As per you, the companies are cheated and the same have been made accused in your complaint. So, they were laundering the money through which they themselves have been cheated.

ASG Raju: No!

ASG Raju (ED): I'm not bound with the quantum and quantity given in the chargesheet by the CBI, it may change at the time of framing of charge. To hold me at this stage with the CBI's chargesheet is not fair in my opinion.

ASG Raju: As far as tampering of evidence is concerned he is influential. Vaibhav Jain retracted his statements. It may not have any affect, but what is relevant is that an attempt has been made for the tampering with the evidences on this ground the bail should be rejected.

ASG Raju: There is evidence to show that he is capable of...when in 2018 he was in jail, Vaibhav Jain retracted his statements.
