#SupremeCourt hearing plea regarding new Constitution and electoral rolls for the Indian Olympic Association.
ASG KM Nataraj takes Court through pleadings.
Details of recent meeting with IOC at Lausanne being read out.
ASG: Our report is also there.
Sr Adv Abhishek Singhvi for IOA: Lordships may have it later and let Justice ( L Nageswara) Rao deal with it, he's already issued a detail Notice. We're in ...
SC: IOC has agreed that Constitution has to be modified and new electoral rolls have to be notified. All this they've said will take place before next meeting.
Singhvi: please see the list, except for two points IOC and I agree
Singhvi: and we're broadly in sync with the HC order. Justice Rao can look into these and keep in mind.
Sr Adv Menaka Guruswamy for Andhra State Olympic Associations: they're (Singhvi) for Mr Mehta (secratary) they should make that clear.
SC: details on record. And let Justice Rao ensure the timeline in our order that the IOC has accepted. It's in everyone's interest that the polls are expeditiously held.
Justice Kohli: Let's just let the Constitution come into place.
Mehra: Timeline for new constitution should be sacrosanct, they shouldn't be allowed to have it extended.
SG: I'm sure Justice Rao will take into consideration consequences of non-compliance of IOC order.
SG: Let us not be negative.
Mehra: It looks like the deadline won't be met.
Order: SG Tushar Mehta and ASG KM Nataraj have placed on record a compilation of relevant documents. The main conclusion which has been summarised in the minutes of the Lausanne meeting are so and so.
Order: The above minutes indicate that the first step as envisaged is for amendment of the IOA Constitution so as to introduce necessary Governance Reforms. IOC and OCA have agreed to work in this regard. Once finalised, IOA general assembly will have to approve the same.
Order: the second step is the elections. The whole process has to be completed before the next IOC meeting in December 2022. Having regard to the same, suggested timelines have been indicated in the note submitted by the Union govt for completing the two processes.
Order: Since a copy of this order will be placed before Justice Nageswara Rao, we would appreciate if the suggested timelines are duly facilitated. Once the new constitution has been adopted by and concurred with by IOC, the IOA is to follow the same.
Order: List after Diwali. IOA shall comply with additional orders by Justice Rao with regard to fees.
Order: Justice Nageswara is at liberty to take a holistic untrammelled view of the necessary amendments with the caveat that the IOC charter is complied with.
SC: List on 11th (November)?
Mehra: IOC is umbilical cord.
SG: We're concerned with national games. If individuals..
SG: don't like it so be it, we will comply.
Mehra: Please also say in compliance with law of land.
SC: As a former judge he has to. We can say inter alia. Govt is now in the middle right?
Guruswamy: first time SG is accused of being on far left (in Court while standing)
SG: We both are more vociferous than the two rival factions. Just because you are lone voice doesn't mean you have to raise it.
Mehra: I'm not anti national, it is in national interest to have the IOA prosper even if we are banned so be it so long as we develop.
Justice Chandrachud: What is happening? SG is far left, you're anti national! We can't tell them to not argue. Only when sending to lower courts we say in accordance with law, else it is presumed.
Bombay High Court is hearing the plea filed by Rutuja Latke seeking directions to BMC to accept her resignation so that she can contest Maharashtra byelections.
Sr Adv Vishwajeet Sawant for Latke stated that BMC had an idea that Latke wanted to resign on Sept 2, 2022. On Sept 29, she was informed that she cannot resign. On October 3, the Election Commission of India declared elections. Same day she formally resigned.
Sawant: Last date for filing nomination is October 14.
Just because of my contesting elections some political view is taken of it.
If there is voluntary resignation, there is nothing pending against me, you have accepted but not given formal acceptance of the same.
