A Varanasi Court today will pronounce its order on a plea filed by the 4 Hindu worshippers seeking directions to the Archaeological Survey of India to conduct 'scientific investigation' of Shiva Linga reportedly found in #GyanvapiMosque premises

District Judge AK Vishvesha had reserved the order on October 11, after hearing the submissions filed by the Mosque Committee objecting to the plea moved by Hindi Worshippers' for 'scientific investigation' of the alleged Shiva Linga found during survey of #Gyanvapimosque

On October 7, the Court had sought clarification on certain questions, which are:

1) Whether Shiva Linga (reported to be found) inside #Gyanvapimosque premises is part of suit property or not?

2) Does court have power to direct 'scientific investigation' of alleged structure?

To this, Hindu Worshippers had told Court that alleged Shiva Linga is a part of suit property.

To second query of the Court, it was said that by virtue of O. 26 R. 10A CPC, Court has power to direct 'scientific investigation' of Shiva Linga reportedly found in #Gyanvapimosque.

Objecting the plea for 'scientific investigation', the Mosque Committee has stated that there is no 'Shiva Linga' found but a water fountain and any disturbance with the structure found inside is not desirable. (contd.)

The Committee has further argued that the Court has ignored the fact that as per the #Gyanvapimosque WAQF survey of 1883, the Mosque was already registered as Plot No. 9130 in the name of the Mosque Committee.

Moreover, it was also argued that the #Gyanvapi survey by UP Government of 1936 also provides that this #Gyanvapimosque is registered in the name of Mosque Committee, which the Court has ignored.

However, the Hindu worshippers had refuted all these arguments.

#BREAKING: DJ AK Vishvesha in the order stated that since the SUPREME COURT ON MAY 16 HAD ORDERED SEALING OF THE PLACE WHERE SHIVA LINGA WAS REPORTEDLY FOUND.

Therefore, this plea of 'scientific investigation' cannot be allowed.
