Gujarat High Court bench of Chief Justice Aravind Kumar and Justice Ashutosh J Shastri is hearing a PIL pertaining to stray cattle menace in major cities and towns in the State.
Pursuant to orders passed on Monday, the DGP, Commissioner of Ahmedabad Municipal Corporation and other officials are present in court.
State represented by Advocate General Kamal Trivedi and Government Pleader Manisha Lavkumar Shah.
AG: What I propose is, during the festive season, we all will sit together n come out with a concrete proposal for controlling cattle menace. We have increased patrolling. It's not that we haven't worked infact all departments have worked like anything.
AG: Human angle is involved Milords. The cattle owners were there from the beginning. The city progressed they lived in the outskirts. However, city's limits kept expanding with passage of time.

CJ: I have never seen any police constable at any important places in Ahmedabad. You can see one or two at only one or two places but nowhere beyond those places. Only you all (authorities) can come with a solution easily.
Bench expresses hope that by the next hearing, after Diwali vacations, concrete steps will be taken.
CJ: But please ensure, that there is no untoward incident during this festive season. The officers are experienced enough, if they mind (to work) it's a child's play for them.
During the hearing, the bench takes suo motu cognizance of the incident of a 35-year-old man, who died after being attacked by stray cattle. It asks Ahmedabad civic body to enhance the compensation to be given to the man's family.
The civic body had decided to pay Rs 2 lakh.
CJ: We aren't happy at all. What is this Rs 2 lakh? He was merely 35... Too small kid he was... Also, what sin he committed? You give Rs 3 lakh even to victims of Hooch tragedy. Please enhance this amount or we will pass orders.
Senior Advocate Mihir Joshi for Ahmedabad civic body opposes the proposal to enhance the compensation. Says taxpayers money cannot be used like this. A policy decision would have to be taken, he submits.
CJ: We understand. So you recover this amount from cattle owner.
CJ: We thought you (Ahemdabad civic body) will be gracious enough to pay enhanced compensation. Pay Rs 5 lakh by tomorrow since your commissioner is present in the court today.

The HC agrees with the trial court's finding that there are some inconsistencies in the statements of some protected witnesses.
