🧵This is not a legal opinion on the domestic law of Scotland. The case law of the ECHR does not mandate self identification. The system of gender recognition we currently have is within the margin of appreciation allowed by the court 1/11
In particular the ECHR has recognised that “stringent” procedures aimed at verifying the underlying motivation for a change of legal identity are justified see page 22 of echr.coe.int/Documents/Guid…. 2/11
This “legal opinion’ contains no analysis of the potential conflict between the proposed system of self identification and the Equality Act and, in particular, of how self ID could undermine the sex based rights of women & same sex attracted people. 3/11
Indeed there is little or no focus on the rights of LGB people which is surprising given the mandate of this Rapporteur. Eg. there is no recognition of the potential conflict of rights whereby lesbians may be forced to accept male bodied people 4/11

& lesbian only spaces. Lesbians, like most women, are used to being told our rights must defer to those of men and it is men abusing a system of self ID which lesbians and women fear, not trans people per se. 5/11
Mr Madrigal-Borloz position reflects his mandate albeit his focus seems to be almost solely on the T not the LGB. When it comes to the rights of women & girls we should defer to Reem Alsalem @UNSRVAW whose mandate is violence against women & girls. 6/11
Sometimes rights conflict. Courts have to deal with this all the time. As @SexMattersOrg have argued “In some situations, conflicts of rights and interests may be a zero sum game. If the rules governing single-sex spaces are changed.. 7/11
..so that some members of the opposite sex are able to enter, those spaces become mixed-sex, and many women will self-exclude. If males who identify as women are housed in women’s prisons, women will feel and be unsafe. 8/11
If males are allowed to play in women’s sport, then fairness and safety for women are destroyed. In this sense, rights are pie and compromises that destroy the human rights of one group are unfair…9/11

Finally we should note the letter is signed by one Rapporteur & does not in every aspect represent the position of the UN. I repeat that on the issue of Violence against women & girls & the UN position on that we should defer to @UNSRVAW 11/11

🧵 I’m at the Supreme Court today for #Indyref2 case. If the UK Govt had any respect at all for Scottish democracy, this court hearing wouldn’t be necessary.
At the 2021 scottish election the scot gov was elected on a manifesto commitment to hold a second indyref. Last time that happened 10 years ago in 2011 the UK govt respected that mandate & entered into an agreement to put beyond doubt the legality of indyref
That’s the established constitutional precedent of the right thing to do in these circumstances. That’s what they shd do now. That they won’t = denial of democracy and its unconstitutional.

🧵Yesterday another man appeared in court charged with threatening me on account of my belief that #SexMatters. I want to be very clear that every time someone in a position of power wrongly describes feminists or LGB people like me as transphobic simply 1/4
because we don’t share their belief in gender identity theory they risk inciting the sort of abuse & threats that I and others suffer from self styled “Trans rights activists” who in truth are nothing of the sort. 2/4
Instead, they are just good old fashioned misogynists & lesbophobes who are being encouraged & enabled by those who ought to know better. I don’t think enough attention is being paid to this problem. It needs to be called out by 3/4

This article was briefly amended to include @ALLIANCELGB side of the story but I can’t see it any more. Some might say that such hysterical anger at LGB people organising to protect their right to be same sex attracted is the very definition of #homophobia

There is much to welcome in the Bill particularly in relation to tackling Child Sexual and Emotional Abuse online. As a former Specialist Sex Crimes prosecutor I am all too aware of how children are targeted online.
Sadly there are those in our society, often hiding in plain sight, who seek to exploit children and so child safeguarding should be a number one priority for any government. In so far as this bill seeks to do that I applaud it.

🧵In the past week both Lorna Slater and Patrick Harvie have displayed an extraordinary insouciance towards human rights and equality law by seeking to brand women who question legislative proposals based on gender identity theory heraldscotland.com/politics/20068…
as “transphobes”” & akin to “racists” and “anti-Semites”. Ms Slater wants us banned from the airwaves & Mr Harvie wants us disciplined by our political parties. They really need to acquaint themselves with Articles 9 & 10 ECHR which protect freedom of belief
& freedom of speech in this country. They could also do with reading & understanding the Equality Act & the decision of the Employment Appeal Tribunal in case of Maya Forstater v CGD Europe which established that discrimination, harassment, and victimisation
