3/ Gohmert’s brief was based on Eastman’s legal theory that Pence had discretion to reject the real electors & count the fake ones and/or throw it back to the states. Even Eastman knew the theory wld fail on the merits. Image
4/ BUT they apparently though that, if Alito got the brief on time (Alito has Gohmert’s district), he wld order a temporary stay to allow briefing on this bullsh#t legal theory. supremecourt.gov/DocketPDF/20/2… Image
5/ They needed more time to twist whatever arms they had to twist & pull whatever strings they had to pull to get an ODNI report falsely claiming that there was evidence of widespread foreign interference, thus enabling them to invoke the executive order they were so keen on.
6/ They seemed to believe that if they cld invoke the Executive Order, this wld enable them to declare martial law and re-run the election.
7/ They seemed to think they cld re-run the election through USAID, which Trump had apparently corrupted with this idea in mind. Image
8/ But they needed that damn ODNI report. When they didn’t get it by 12/18, they had that wild meeting at the WH. Image
9/ It appears that Gohmert’s brief was a delay tactic. And when the brief didn’t get to Alito on time, the Capitol was breached to give Alito more time. They did not expect Nancy to reconvene Congress until at least the following day. But she outsmarted them.

11/ I actually think the breach served multiple purposes. But delaying the certification was an important one.
12/ Note also that Stone, Powell, etc seemed to want Trump to invoke the Executive Order and/or the Insurrection Act even w/o the ODNI report.
13/ It’s not a stretch to think that Trump wld have Invoked the Insurrection Act had the bombs gone off and/or had anti-fascist protesters shown up and battled w/ pro-Trump protesters. But neither occurred.

16/ Time. They needed more time. They needed to delay certification. Because they didn’t have that damn ODNI brief & Trump was not persuaded to invoke the Insurrection Act or EO without it.
17/ Gohmert participated in the Dec 21 meeting.
18/ Gohmert was among the people for whom Roger Stone sought a pardon.

22/ Roger Stone was not only seemingly on board with the SCOTUS/Gohmert component of the plan, but also w/ the Executive Order/foreign interference component. He & Alex Jones discussed it as shown by @gal_suburban.

31/ To recap: Trump wanted to invoke the Insurrection Act & then use a corrupted US Aid to re-run the election. To do that, he needed a pretext, something official confirming election interference. When he lost in court, he hoped to use the ODNI report instead. But they …
32/ needed more time bc they did not have the report yet. So they hoped to use Eastman’s BS legal theory as a pretext to get Alito to stay the Jan 6 certification of Biden’s win to allow time to brief & argue the BS theory.
33/ Except the real purpose of the proposed stay fwas to buy more time to get “official” confirmation of foreign interference from ODNI or any other agency he cld corrupt.
34/ Flynn & Powell apparently thought they had created enough smoke to allow Trump to invoke the Insurrection Act even w/o “official” confirmation of foreign interference. But Trump had cold feet. So they tried to get the stay.
35/ But they couldn’t get the brief docketed in time for Alito to issue the stay before the planned certification at about 2 pm. So they needed the Proud Boys, Oathkeepers etc to stop the certification process to give their Alito plan a chance.
36/ They got Gohmert’s brief docketed at 3:51 pm on Jan 6. Trump called off the mob soon after. Image
37/ Alternatively, had the bombs gone off and/or had their been a massive clash between Trump supporters and anti-fascists, Trump might have used that as a pretext to invoke the Insurrection Act.
38/ In any event, bc Congress had been evacuated, Powell apparently thought the insurrection had bought enough time for Alito to issue the stay (presumably the next morning). But Pelosi outsmarted them by calling Congress back that night and certifying Biden’s win.
39/ Alito and Thomas are fans of hearing cases, even if they deem them frivolous. The question is not whether Alito would have agreed w/ Gohmert’s BS legal theory, but rather whether (had he received the brief b4 1 or 2 pm) he wld have stayed certification…

Tulsi’s report seems to me like an attempt to distract. As I detailed on Medium, Obama stated in Dec 2016 that, “We have not seen evidence of machines being tampered with *** That doesn’t mean that we find every single potential probe of every single voting machine across the country. But we paid a lot of attention to it. We worked with state election officials, etc. And we feel confident that that didn’t occur.” 1/Image
