Supreme Court to the Ministry of Defence in a One Rank One Pension case:
CJI DY Chandrachud: This is not a war but under the rule of law. Set your own house in order. If not we will issue a contempt notice to the Ministry of Defence
Sr Adv Huzefa Ahmadi: When this court passed an order how can the department reserve the right to modify it? 4 lakh pensioners have passed away in the interregnum and they cannot claim the pension #OROP
Ahmadi: They are pensioners and these 4 lakhs will never get OROP. These are retired army personnel
CJI: Bu Judgment of March 16, 2022, arrears of OROP was to be paid within 3 months.
Ahmadi: They should pay interest now if orders have been taken for granted.
CJI: Defence ministry sought an extension and it was granted by order dated Sept 16, 2022. By Jan, 2023 further 3 months extension was granted. In the meantime a communication has been issued which states on arrears: Para 6 states time extended till March 16, 2023
CJI: Defence Ministry Secretary to the pension scheme is directed to file a personal affidavit on why this unilateral direction passed when SC had passed orders. #OROP#SupremeCourtOfIndia
CJI: After March 15, interest at the rate of 9% will be directed if...not ordering now. Please file affidavit and we will list it after Holi Holidays #SupremeCourt
