#SupremeCourt to hear contempt plea in relation to social media posts made by founder of IPL, #LalitModi against his family members and also against Senior Advocate and former Attorney-General Mukul Rohatgi, who is representing his mother Bina Modi in their family dispute
Sr Adv AM Singhvi for Lalit Modi: Kindly take the affidavit for the alleged contemnor.
Reads from the affidavit tendering unconditional apology.
Singhvi: This is more than sufficient....your lordships may let it rest here. This is genuine, unconditional, comprehensive and wide apology.
Justice Shah: Where have you mentioned it that it would not be repeated again.
Singhvi: Yes...Kindly see 3.
Justice Shah: Everybody should respect the institution as a whole, that was only our concern.
Singhvi: We understand.
Sr Adv Ranjit Kumar (for petitioner): The word ‘future’ is not there in these newspapers.
Justice Shah: It is there in the affidavit. What is important is that it is in the affidavit.
Justice Shah: You tell him not to...
Singhvi: Had he been in India, I would have personally told him.
Bench: Lalit Modi filed affidavit tendering unconditional apology for social media posts. In the affidavit he has assured and undertaken that in future he will not do anything which is inconsistent with the majesty or dignity of Hon’ble Courts or Indian judiciary in any manner.
Bench:...It is also stated in the affidavit that in accordance with the earlier order passed by this court, he has published this apology in Twitter account and leading neswapapers have wide circulation...
Bench: Dr. Singhvi...has stated at the Bar that the objectionable post has been deleted from the Twitter account immediately after the same was posted and they are no longer available on social media/Twitter account.
Bench:He therefore has prayed to show grace & accept unconditional apology tender by the respondent by further submitting that the unconditional apology is from the bottom of his heart, genuine and bonafide and not to get out of adverse orders in the present contempt proceedings
Bench:..affidavit tendered on 17.04.2023 is reproduced herein above and with hope and trust that the unconditional apology tendered is genuine and that now the respondent condemner has stated on oath that no such social media post would be posted in future...
Bench:..we accept the unconditional apology. We remind the respondent that any such attempt on his part in future which would tantamount to remotely tarnishing the image of Indian judiciary and courts will be seen very seriously and we desist him from indulging in such activities
Bench: We accept the unconditional apology with broad heart because the Court always believes in forgiveness more particularly when apology is tendered unconditional and from the bottom of the heart...Accepting the apology we close the present proceedings.
