#liberals The 10A DOES NOT restrict the fed govt to powers expressly stated in the Constitution. Chief Justice John Marshall made this clear in McCulloch v. Maryland when he shot down the claim that Congress has no express powers to create a bank and therefore is forbidden from doing so.
