We all remember the beloved Harpreet Singh Bedi from the movie ‘Rocket Singh: Salesman of the Year’ played by Ranbir Kapoor.
He started a company, Rocket Singh Corporation while being employed at AYS Computers, doing the same business as AYS. He even roped in other employees of the company to run Rocket Singh Corp with him.
The movie did have a happy ending with Harpreet becoming a successful businessman in the end, but do you know that you could face legal consequences from your employer for a crime similar to Rocket Singh’s?
If you work in the private sector your employer may add a non-compete and non-solicitation clause in your employment contracts.
- A non-compete restricts you from competing against your employer in the same or similar business while still being employed with them.
This clause is usually to prevent employees from learning trade secrets from one company and then taking them to competitors or starting a competitor company..
- A non-solicitation clause restricts you from hiring other employees or poaching customers from your ex-employer to start your own business or joining your new employer, that would ultimately harm the business of your ex-employer.
If Harpreet had non-compete and non-solicitation clauses in his employment contract, he could have been sued by AYS Computers for breach of contract.
- Even if your contract does not mention these clauses, depending upon the type of your employment, criminal charges such as theft and hacking can also be brought against you like Harpreet Singh was in the movie
- Violation of such clauses is taken very seriously by courts and usually, hefty fines are imposed as punishments.

@INBreakthrough@UngenderTalks First key difference is that S. 498A is a penal provision focused towards punishing the abuser with 3 yrs jail time & fine. Whereas, PWDVA is a civil law that aims to provide protection to women from harassment in the form of monetary relief, residence order, etc.

PWDV Act, 2005, gives a broad definition of what qualifies as ‘domestic abuse’. It includes physical, sexual, verbal, emotional and economic abuse. Section 3 reads:
The Act provides for a ‘Protection Officer’ to help you through various processes under the law. This Officer can help you file the complaint, tell you about your rights, make an application to the Magistrate for you, etc.

When someone at a place of work behaves in a sexual way towards women and it is unwanted, offensive, threatening, or humiliating, it is seen as a form of harassment.
There is no fixed definition of sexual harassment. It would change from person to person, but most importantly, it depends on how comfortable the woman is with the behavior.
