This is interesting "The FBI had in their possession transcripts of the relevant calls." From interview of Peter Strzok. Notice how they don't identify HOW or by what means that Peter Strzok was in possession of that transcript?

Not to the clueless this is important, the revelation the other day said Comey ordered the investigation closed. So who on the 7th Floor are Strzok & Page speaking for?

Who is countermanding Comey's order to close the Flynn case?

So we can see Brennan & Yates trying to push Comey to weaponize the Flynn Kislyak call against the White House.

Yates went as far as to order Comey to notify the White House (her trying to get Flynn fired) but Comey had already allowed McCabe to send the agents into an ambush which ruined Yates plans.

So who was being so pushy about interviewing Flynn?
McCabe who had several conversations with Bill Priestap pushing him to let Strzok take this unusual step.

Who's notes were released last week showing he worried this was a major problem? Priestap.

Priestap even tried to call out McCabe in front of Comey to address his concerns, and McCabe cut him off to avoid letting Comey know what McCabe was up to!

McCabe then made the call before any maneuvers could block the interview.

This is why people who aren't very smart don't get Comey's slight of hand: Comey doesn't say Flynn lied, Comey doesn't say he believes Flynn lied, Comey says “I don’t know. I think there is an argument to be made he

A 100% non-committal answer!

The new information makes it unclear if a crime was committed & the DOJ is now convinced that it could not prove one beyond a reasonable doubt even if a crime happened!

This is beautiful, because Strzok, Page & McCabe kept the CI case open after Comey approved closing it & never opened a criminal case they couldn't get approved, there was no valid investigation for Flynn to obstruct with his 'lies'. Their back door turned into a trap door!

So McCabe's back door to keep Crossfire Razor open is now considered to be a fatal flaw in the entire investigation. Flynn could have lied to them all he wanted without a crime, because there was no valid CI or criminal investigation to impede!

DOJ says Flynn Kislyak calls were appropriate for a transition official and provided zero evidence relevant to either a CI foreign power case, a FARA case or any other kind of investigation that McCabe attempted to justify off of them!

Not only that, the FBI possession of the exculpatory transcript was adequate evidence that there was no case & no need to interview @GenFlynn

They also note the FBI never opened a Logan Act case against Flynn because FBI leadership would not have approved it. Yet McCabe authorized Strzok & Page to use the CI case that had been ordered closed to avoid facing that hurdle.

Ouch, the calls "did not constitute an articulable factual basis to open any counterintelligence investigation or criminal investigation." So the CI case should not have been kept open to bypass the FBI Director's authorization to close it.

That the excuse of lying to the Vice President, didn't come about until weeks AFTER they tried to open the Logan Act issue. Even if true, Flynn lying to his boss was no an articulable fact for either a criminal or CI case!

So who violated policy & tried to trick Flynn into the interview? McCabe & his minion Strzok...

I'm sure Strzok says he was only following orders.

I'm sure Yates was "flabbergasted" and "dumbfounded" she had staked everything on the coup & Comey let McCabe walk into an ambush exposing everything!

Since FBI had the transcripts & their were no criminal or intelligence issues identified in them, DOJ says the entire interview was just a test of what LTG Flynn recalled from the phone call.

The DOJ can't even explain, much less prove, who @GenFlynn's statements would be a crime even if they were lies! Even if he told the truth, there were still no criminal or CI issues of concern from his phone calls or answers!

Neither the truth or the 'lie' could have had any effect on any lawful FBI criminal or CI investigation.

Even if it might be relevant, DOJ doesn't have evidence to prove LTG Flynn knowingly & willfully lied. They even quote the agents with the impression that Flynn was not lying!

Note 2 of the reasons DOJ says they can't prove it!
1. "inconsistent FBI records as to the actual questions and statements made" the various rewrites of the 302 & notes.
2. Comey's statement that the case for lies was a "close one" was DOJ's evidence that it could not prove it!

There we have a major issue, people who don't get lawyer speak will give you #FearPorn Comey condemned Flynn by saying a case could be made that he lied. DOJ heard the same statement & considered it exonerating evidence in Flynn's favor!

Footnotes! Flynn's statements had no materiality to Crossfire Hurricane & that investigation did not justify the interview!

Bigger footnote, We're sorry Judge Sullivan that previous DOJ filings tricked you into thinking the statements were material. Our new evidence shows the nature of the investigation was not what you were told by earlier prosecutors! Doesn't say those prosecutors knew it though...

@GenFlynn's guilty plea wasn't valid because he was unaware of all of this exculpatory evidence. Too bad he didn't have a law firm attempting to find this material & exonerate him!

DOJ is now here to exonerate LTG Flynn, even if his defense counsel did not do so! Prosecutors have a duty to justice not convictions!

Leaving no way for anything other than Judge Sullivan approving the dismissal of the case!

Wonder if he will be satisfied with the new DOJ investigation or will want his own Special Prosecutor like he did to investigate DOJ in the Ted Stevens case?
