Supreme Court bench headed by Justice UU Lalit hears plea by LG Polymers, challenging NGT’s order passed in its suo motu case constituting a monitoring committee to look into the Vizag #gasleak tragedy

#SupremeCourt had allowed access to 30 company personnel into the plant in its last order for maintenance etc.
Senior Advocate Mukul Rohatgi appears for LG.

Rohathi: There are two petitions here. The first challenging the NGT Order and the other challenging the Andhra Pradesh HC order.
Rohatgi: The directors of the company were told to deposit their passports and the HC has no jurisdiction to pass this order.

The SC had directed 30 personnel to enter the gas leak site out of which 2 were lawyers. However, the District Magistrate did not allow this.
Justice Lalit: Did you ask for a nod from authorities to take out the hazardous gas?

Rohatgi: My plant which is a highly specialized one has been sealed. This order of sealing without an expert opinion is wrong.
Rohatgi: The HC has still not taken up the matter.

Reads the NGT order. " So many committees have been formed to oversee this issue."
Rohatgi: My argument is that the Collector had no reason to prevent the entry of two personnel just because they were lawyers, even though the Supreme Court had directed the entry of 30 personnel into the plant vide its last order
Rohatgi: Are we criminals that we will run away ? I am challenging the plant seal order and the one by which directors were compelled to deposit passports.

J Lalit: But the NGT order is not challenged here
J Lalit:  We request the High Court to dispose off all the pending applications within this week itself. The disbursal of 50 crores already submitted by LG Polymers be restrained.
J Lalit: The pending applications with AP HC needs to be disposed off considering the vacations are over too.

Rohatgi: The sealing is unconstitutional

J Lalit: we will not entertain this. The leak was the manufacturer's fault
The 3 applications by the LG Polymers pending in AP HC : access to the plant, to access material so that the company can respond to various committees. SC directs HC to dipose of these applications by end of next week
NGT order of deposit of 50 crores, now pending for disbural restrained for 10 days by SC.

LG Polymers now intend to challenge the NGT order of June 1, 2020. The company is set to move the Andhra Pradesh HC for the relase of the passports of their Directors too
